Can one secure an extension for a K1 Visa? :unsure: I don't think so!

If so, how? :help:

If Not... What happens if you marry after the expiration date of the 90 day K1 visa. Any penalties or what?

I read once, it is wise to just go to the courthouse and get the 'marriage' done... Don't wait on a fancy wedding (if that is the hold up for you) just get married... Find someone who is licensed to perform the ceremony, and grab 2 witnesses off the streets if you have to... A formal wedding can take place any time after!

  • July 16, 2006 Met in person on her birthday in United Arab Emirates
  • August 4, 2006 sent certified mail I-129F packet Neb SC
  • August 9, 2006 NOA1
  • August 21, 2006 received NOA1 in mail
  • October 4, 5, 7, 13 & 17 2006 Touches! 50 day address change... Yes Judith is beautiful, quit staring at her passport photo and approve us!!! Shaming works! LOL
  • October 13, 2006 NOA2! November 2, 2006 NOA2? Huh? NVC already processed and sent us on to Abu Dhabi Consulate!
  • February 12, 2007 Abu Dhabi Interview SUCCESS!!! February 14 Visa in hand!
  • March 6, 2007 she is here!
  • MARCH 14, 2007 WE ARE MARRIED!!!
  • May 5, 2007 Sent AOS/EAD packet
  • May 11, 2007 NOA1 AOS/EAD
  • June 7, 2007 Biometrics appointment
  • June 8, 2007 first post biometrics touch, June 11, next touch...
  • August 1, 2007 AOS Interview! APPROVED!! EAD APPROVED TOO...
  • August 6, 2007 EAD card and Welcome Letter received!
  • August 13, 2007 GREEN CARD received!!! 375 days since mailing the I-129F!

    Remove Conditions:

  • May 1, 2009 first day to file
  • May 9, 2009 mailed I-751 to USCIS CS

The marriage is not the problem... it is the time limits the lawyers want for a pre-nuptual agreement some want 7 days notice for prenup', which we do not have... other want 3 months, which is what we all only had!

Her visa expires on the 9th of August, today is the 3rd, can't seem to get even a liar, oops, I mean an attorney to squeeze 7 days into 4 days? I guess not enough hours in four days to pad the bill!

What happens If I marry her after the 90 days?

What happens if I marry an Illegal alien?

You can not extend the K1 visa.

If you marry after the 90 days, she will not be able to adjust status from the K1, but you can file an I-130 along with your I-485 for adjustment.

It's not the end of the world. A few overstay days will accrue, but they will be forgiven with the AOS.

05/02/2007 Driver's License - Passed Road Test!

05/27/2008 Lifting of Conditions sent (TSC > VSC)

06/03/2008 Check Cleared

07/08/2008 INFOPASS (I-551 stamp)

07/08/2008 Driver's License renewed

04/20/2009 Lifting of Conditions approved

04/28/2009 Card received in the mail
