Timeline

My fiance had his interview with the Mumbai Consulate on December 21, 2009. As of today, almost 4 months later, we are still in AP and waiting for an answer to our case. We have submitted more evidence of a relationship as they requested, but nothing. Is there anyone else who is waiting in AP with the Consulate with the same, or similar, story? Anyone who has received a visa after from the Consulate after a situation like this...and have any suggestions for those of us who are waiting? Any suggestions on how to speed up the process...please post!

And they've given you the generic answer?

I'm afraid there's nothing you can do apart from wait.

Maybe the USC can get their Senator/Congressman involved?

What were your missing documents btw?

Thanks. I am the USC. I tried a Congressional Inquiry right after the interview, but I think it was too early. I am considering involving one of my Senators. They said that we didn't have enough evidence of a bona fide relationship, even though we had pictures, letters, tickets and other materials from where we met, etc. We even sent them 4 letters after they gave my fiance the 221(g) letter in December....still nothing...

The only thing that I can add is I would look to see when your I-130 petition expires, and if it is going to expire anytime soon I would put in a request to extend it... I read somewhere that they were on AP and there I-130 petition expired so they had to start back over... IDK.... best of luck!!!

To still be in AP for that long is not too strange coming from India/Pakistan/Bangladesh. I have seen this trend becoming more and more prevalent. I mean, look at us, over 5 months of AP and we were missing no documents, and received no slip after the interview. Just told that the CO believed our case was legit and that he thought our intentions for migrating to USA were for the best. He said that people here in South Florida dont really speak Punjabi.. haha.. so my husband said "Its ok, I speak English and Urdu too." anyhow. dont fret the time period you have been waiting. Unfortunately, some people have been in AP for more than a year, but it is usually very rare. I think you will be just fine. remember, no news is good news. My senator's liason told me after 3 and a half months of AP that I should be glad it's taking so long because that means they are checking everything completely and thoroughly so there wont be any delays later. So... good luck with your case and I am sure eventually you will hear something. take care.

How many letters and other materials were sent? Pictures are considered secondary evidence so they are no good just by themselves. Think as a CO, what would they like to see as evidence of bonafide marriage? Pictures, cards, letters can be faked. trips planned together, your plans (marriage, honeymoon, trips)after she comes here is what they want to see more. Receipts of gifts, engagement ring, engagement ceremony (if any). Be creative. How many trips have you made to see her? The above bolded statement makes your AP different from others who are put on AP for background checks. Good Luck.

Another thing, did you both talk about all the questions & answers during the interview? Did she not know an answer or gave some wrong answers? In the end something happened for the CO to believe that the relationship is not genuine. You will need to overcome this suspicion.

Just saw, you applied for fiance visa and I-129f does expire but usually they will extend it without you having to ask for it. Since yours is in AP, send a letter asking for extension.

Agree with Parul. 129fs do expire, but since it's in AP at the consulate level, it is already considered to be extended. However, do send a letter in just to be on the safe side.

How'd the interview go? What questions were asked? What were the responses given?
