I-864 - Part 3 Information on Immigrant(s) Sponsoring

Timeline

My Fiancée arrived last month via her K-1 and we recently married. My Stepdaughter arrives next month via her K-2. I'm now assembling and completing my wife's AOS to send off next weekend.

One section of the I-864 Affidavit has a question that is driving me crazy: Part 3 #9: Information on Immigrant(s) you are Sponsoring. At first I did not check the box (question #9) but if you read it thoroughly, it states "I am sponsoring the following family members immigrating at the same time or within six months of the principal immigrant....."

Since her daughter will arrive via her K-2 next month, perhaps I'm required to check this box and list her on the form?? On the other hand, the next sentence states "Do not include any relative listed on a separate visa petition. These two sentences seem to contradict each other.

I will have to send a complete AOS package for the daughter which will include an I-864 so I'm wondering whether to include her on her mother's I-864 or not. Any advice is appreciated. Thanks.

I don't think your stepdaughter is on a seperate petition as the K2 is a derivative visa, not a stand alone. I would include her on your wifes I-864 if she will be here soon.

That's correct now, she's a derivative of her mother now that you mention it. I'll still have to provide an I-864 for the K2 daughters AOS but I think you're probably correct unless someone comes back with another idea. Thanks!
