some questions regarding AOS

Hey guys!

I just got my K1 visa :-)

…I have some questions regarding the next step (adjustment of status)

1) I am from Germany. Do I have to sign up for “ESTA” (Electronic System for Travel Authorisation) or is it just for people who are travelling without a visa?

2) is the fee for the I-485 (adjustment of status application) $1010?

3) how much is the fee for a civil surgeon to certify my vaccination history?

4) for the I-864 (sponsor document), do I have to provide the same documents as for the I-134 which I turned in on the interview day?

5) by passing the boarder (port of entry) I will get a work permission for three months (EAD card). When do I have to extend this card (how long is the processing time)? For how long is the new card valid?

6)After sending in the I-485 form, how long do I have to wait until I receive the green card?

7)After how many years can I apply for naturalisation?

8)If I want to take some classes at a university, do I have to pay the local fee (which is way cheaper than the fee for exchange students) since I will have a green card?

Thanks for your help

Hey guys!

I just got my K1 visa :-)

…I have some questions regarding the next step (adjustment of status)

1) I am from Germany. Do I have to sign up for "ESTA" (Electronic System for Travel Authorisation) or is it just for people who are travelling without a visa?

The K-1 is your visa. You do not need ESTA.

2) is the fee for the I-485 (adjustment of status application) $1010?

Yes - usually. (depends on the age of the benificiary)

3) how much is the fee for a civil surgeon to certify my vaccination history?

Varies - ours was $70.00 ($20 extra for the shot needed)

4) for the I-864 (sponsor document), do I have to provide the same documents as for the I-134 which I turned in on the interview day?

Yes. (tax transcripts, letter of employement, things like that) However, if you AOS after april 15, you will need the current years tax info.

5) by passing the boarder (port of entry) I will get a work permission for three months (EAD card). When do I have to extend this card (how long is the processing time)? For how long is the new card valid?

I would not recommend this. Your spending extra money for a limited time thing. When you file for the AOS, you can get the EAD, which is good for one year, is renewable, and is "free" by virtue of the AOS process.

6)After sending in the I-485 form, how long do I have to wait until I receive the green card?

Varies - ours took 2.5 months (give or take a week) - indeed, our AP/EAD came two days before our greencard came.

7)After how many years can I apply for naturalisation?

3 years after you get the greencard - if married to the USC (still) - if not, five years. (in both cases, you have to follow the rules for USC)

8)If I want to take some classes at a university, do I have to pay the local fee (which is way cheaper than the fee for exchange students) since I will have a green card?

You won't be an exchange student - each school has their own pay structure - you would need to check with them.

Thanks for your help

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

Hey guys!

I just got my K1 visa :-)

CONGRATULATIONS :)

…I have some questions regarding the next step (adjustment of status)

1) I am from Germany. Do I have to sign up for “ESTA” (Electronic System for Travel Authorisation) or is it just for people who are travelling without a visa?

NO YOU DO NOT NEED TO SIGN UP FOR ESTA, YOU JUST NEED YOUR VISA

2) is the fee for the I-485 (adjustment of status application) $1010?

YES, I APPLIED FOR MY AOS ON FEBRUARY AND WE PAID $1.010,00 FOR FEES

3) how much is the fee for a civil surgeon to certify my vaccination history?

IT DEPENDS ON A LOT OF THINGS ... WE PAID $35,00

4) for the I-864 (sponsor document), do I have to provide the same documents as for the I-134 which I turned in on the interview day?

YES

5) by passing the boarder (port of entry) I will get a work permission for three months (EAD card). When do I have to extend this card (how long is the processing time)? For how long is the new card valid?

YOU WILL NOT GET WORK PERMISSION FOR THREE MONTHS WHEN YOU ARE PASSING THE BOARDER.

WHEN YOU ARE GOING TO APPLY FOR YOUR AOS ... ALSO, YOU COULD APPLY FOR THE EAD

6)After sending in the I-485 form, how long do I have to wait until I receive the green card?

WE HAVE SENT OUR AOS ON FEBRUARY, 22ND AND HAVE NOT GOTTEN ANYTHING YET ...

ACCORDING DIFFERENTS TIMELINES, IT IS GOING TO TAKE ABOUT 3 OR 4 MONTHS

7)After how many years can I apply for naturalisation?

I THINK IT IS 3 YEARS BUT NOT SURE ...

8)If I want to take some classes at a university, do I have to pay the local fee (which is way cheaper than the fee for exchange students) since I will have a green card?

I WANTED TO TAKE SOME CLASSES AT A UNIVERSITY TOO, ACCORDING TO THE UNIVERSITY WHERE I WANT TO GO, I HAVE TO PAY FEES FOR "FOREIGN STUDENTS" BECAUSE I DON'T GET MY GREEN CARD YET ... THE BEST IS TO WAIT FOR YOU GC

Thanks for your help

Point 8)

You cannot simply take "some classes" at a University. If you want to do that, it would be within the framework of Adult Education for "non-registered" students. Expect to pay around $350 per 3-unit class. A Bachelor's degree takes at least 60 units.

If you want to study part time, you need to enroll. For that you need to be accepted as a student. Think (numerus clausus.) In regard to fees, in California and many other States there is a residency requirement. Simplified, once you live in California for a year, you are a resident. The same fee structure applies for community colleges.

Short answer: depending on the State you're moving to, you might have to wait a year.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . The one absolutely certain way of bringing this nation to ruin, of preventing all possibility of its continuing to be a nation at all, would be to permit it to become a tangle of squabbling nationalities, an intricate knot of German-Americans, Irish-Americans, English-Americans, French-Americans, Scandinavian-Americans or Italian-Americans, each preserving its separate nationality, each at heart feeling more sympathy with Europeans of that nationality, than with the other citizens of the American Republic . . . . There is no such thing as a hyphenated American who is a good American. The only man who is a good American is the man who is an American and nothing else.
