Hi,

I am on F-1 Student Visa but i have recently married a US citizen and we are applying for the green card. I know i can also apply for OPT through the form i765 but for now i am applying for work authorization through the process of Green card through marriage. I have to file the form i765 with my other forms i130,i485,G325A and i864 and i am confused about the category question no 16. Which category i fall in? I think its c9 based on what i read in the instructions document but if somebody can shed more light on it?

I may be wrong but in the instructions it says that c9 is for K-1 nonnimmigrant fiances. And you are adjusting from an F-1 not a K-1.

You may want to have your post moved as well, you are not adjusting from a family based visa.

Your category should be c9.

a6 is for K-1.

If she is a C9 can you explain the instructions on page 4 of the instructions for the I-765 bottom of page 4 on the left side?

I-765 instructions from USCIS website

"" K-1 nonimmigrant Fiance(e)of a US Citizen or K-2 Dependant-- (a)(6)

File Form I-765 if you are filing within 90 days from the date of entry. This EAD cannot be renewed. Any EAD application other than for a replacement must be based on your pending application for adjustment under( c )(9). ""

Also found on visa journey website step by step guide to filing AOS from k-1 it is also listed as c9.

VJ step by step K-1 EAD

"" At the same time as filing for AOS. As a K-1 holder filing for Adjustment of Status (AOS) you are eligible to file for an EAD at the same time. Your EAD packet can be filing along with your AOS packet and mailed together. You will file as category (c )(9), "adjustment applicant". (Where to file: mail only - with AOS packet) ""
