My understanding from the OP's responses is that they have come here to the U.S. from Canada as a visitor, got married, and now they're applying for AOS. Yes, your arrest/conviction for theft under is going to be an issue. Another poster from Canada was denied her K-1 due to this, and had to apply for a waiver. It had happened 20 years ago. I'm still not understanding the whole deal with your lawyer.

I would suggest you go BACK to your lawyer, if that's what you're doing to apply for your AOS and tell him the truth. Saying no, instead of yes, is not going to bode well for you unless you address this NOW.

I don't know what paperwork you seem to have. A copy of your criminal record will not have whether you're guilty or not on it, but will have the charge, and it's disposition. Do you even have a copy of your criminal record? If not, get one. As well, get any police reports pertaining to the offence.

Thank you all for the replies .

We didn't plan lie to anyone , my lawyer knew about it and he asked me to get the paper from the court , which I did , but it's not his fault if we made a mistake . he asked us to make sure that everything is ok and as I said we were so worried to do everything right that we screwed the most important thing in our application.I can not blame him for our mistake. I learned long time ago that don't blame other people for your own mistake and also lying don't get you anywhere close to success specialy to officials.

it was just a stupid mistake from our side. he knows that it's wrong in pplication and he said he can't do anything about it now , we have to just wait for our interview date and spoke to our officer about that.

Please wish me luck , I don't know what will happen If they decline my application.I hope I don't get stuck here for a long time beacuse I missed my country and I would love to go back and visit my people and my country.

Give me a break, in my book that is pretty much a ridiculous non-issue, not worth losing sleep over.

i just thought i'd let you know nashenakhteh that you are not the only one! i also put 'no' to the question if i was ever arrested or convicted and i was arrested. however my records do show that the charges were never put thru so my record is clean, however i still put 'no' to that question and i have been arrested. i have been stressing as well, i have a k1 interview on march 30th. i'll let you know what happens in regard to the 'yes' or 'no' question, if they bring it up or not. but i think that i will bring it up anyway if they ask me if i have been arrested.

Give me a break, in my book that is pretty much a ridiculous non-issue, not worth losing sleep over.

The offence was "dismissed" by way of sentence. Therefore it's a conviction. There was also an arrest that even then would have to be disclosed. Secondly, I don't see anywhere where it's the lawyer's assistant that made a clerical error?

I just want to give whoever is interested an update on my case and thank everyone who gave me a reply .

last week I had my interview , that was a very quick and easy process.

well , I told them about my mistake in application and I provide them with the paperwork.

the only think the officer asked me was if the incident happened in the united state. he wasn't seem to be very interested in details and he didn't ask us any question. and I got approved at the end of interview :):):)

actually he was very nice and the whole think took us only 15 minutes.

and big news :) today i got my green card , woooooooooooohoooooooooooo

I really apprecitae all the replies , and one suggestion to the people with my case is , I think the whole thing depends on your officer unless the incident was very serious .

I pray for every one in this journey.

i had my k1 interview yesterday with the same issue of answering no to that question and i was just honest and explained why i answered no and the officer was very nice and said it was such a minor charge that it wouldn't have stopped me from getting my visa. so i think it's best just to be honest and they will understand.
