I know there's been a lot of questions about Part 3, but I haven't seen an answer to my particular question. I've asked around without success other places so I wanted to give it a try here to see if anyone knows:

My question about Part 3 of the I-485, deals with specifically:

Nonimmigrant Visa Number

Date Visa was Issued

My husband has been in the US since 1989. We have his I-94, which is stamped from his arrival and shows he was admitted on a B-2 visa. He is an overstay. (I list his current USCIS status as B-2 Visa Overstay).

The passport he arrived on is long gone. As in 20 years gone. He holds a current passport, but not this original one.

Would there have been a visa in the original with a number? What do we do since we don't have this number? "None" or "N/A" doesn't seem to be the right choice and I know leaving anything blank is not a good idea. Do we write "Unknown/Lost" or something else? Will it result in a RFE?

Even if his original passport has expired, when he received a new one, they should give you the old passport back as well... at least that's what happened in my case. My non-immigrant visa is in my old passport and my current passport is the one I use.

Your husband's old passport should have the B2 visa stamp and on the stamp there will be a number in red which is the non-immigrant visa number.

17th June 2010 - Approval notice for I-130 received. Also received "Welcome to USA" letter biggrin.png
28th June 2010 - Finally received my GC.... Praise be to God smile.png

16th March 2012 - Sent ROC package
21st March 2012 - NOA1 date
20th April 2012 - Received Biometrics letter for 16th May

December 2012 - Received 10 year GC

01 Nov 2013 - Sent naturalization package

18 Feb 2014 - Oath ceremony done, naturalization complete!!

Even if his original passport has expired, when he received a new one, they should give you the old passport back as well... at least that's what happened in my case. My non-immigrant visa is in my old passport and my current passport is the one I use.

Your husband's old passport should have the B2 visa stamp and on the stamp there will be a number in red which is the non-immigrant visa number.

The old passport is lost. That's why a new one was issued. So we don't have the 20 year old one or the visa that was inside unfortunately.

Ahhh.... Maybe he can try getting in touch with the US embassy in his home country, where the visa was issued. They might have a record of it and may be able to help out. I'm not entirely sure whether or not USCIS will have problems with your AOS application if you don't have the visa number and the date of issuance filled out.

Another option could be setting up an Infopass appointment and checking with the person there, on what can be done and whether it will be a problem.

No , it has a number that she needs in order for them to verify if he entered US legally which is essential for the his AOS.

Why don't you try calling US Department of State and try to find out what options do you have? Maybe they have the info that you need in their archives.

Thanks for all the responses so far. It's frustrating - it's the one thing we don't have. We even have all of the original plane tickets and copies of things like that show how he got here 20 years ago. Just no visa or original passport. I thought for sure someone else would have lost this document and I could find a similar story but so far no such luck!

I know that this is frustrating. Did you try to call the USCIS Customer Service and ask them if they will be able to find out the visa number if you don't know that ?( in my opinion they have better communication with US State Department) I would suggest that if you do call to try to talk to a 2nd tier person because the first people don't really know anything and I doubt that they can answer this question.
