What is in the Packet 3 for K-3 Visa

Hello everyone. On the US Embassy website for BA, at website address http://argentina.usembassy.gov/faqs4.html#b

The website states ¨You may begin to apply for the fiance(é) visa before the approval of your petition by requesting from this office a packet of forms and instructions referred to as "packet 3". ¨

I wrote to the Embassy to request a "Packet 3" be delivered to my husband in Argentina.

First they wrote back saying they can not send the pkt 3 until the case arrives. The documents have certain validity and may be expired the date of case arrive.¨ They also told me it takes between 6 and 8 weeks fo the appointment AFTER they recieve all of the documents from the packet 3. We are talking MONTHS between the time the visa number is approved, and the time he can come into the country.

I wrote back to them referring to the website instructions, and recieved this email. ¨Those instructions changed and we are not able to send you the information before the case is here. We are updating the web page.¨

I know everyone has a sad story- but my husband was in the US on a P-1 visa for the last five years, where he built his business...now he has been out of the country for 4 months and is on the verge of losing his business if he can´t be in by January.

We are desperate and I am just wondering what we can do to get ahold of the packet 3 information and the checklist to get started on it before our I-129F information has been sent to the Embassy.

Any info would be appreciated.

I know everyone has a sad story, but my husband was in the US on a P-1 visa for the last five years, during which he built his own business. Now he has been out of the country 4 months and is on the verge of losing his business if he can´t be in by January.

Perhaps he should've thought about his business, before leaving the US.

I will assume that comment was made in support, since this is a forum where we are supposed to be helping one another.

My husband left the US because his father was admitted into Cardiac Intensive Care. At the time he also had his P-1 Visa pending, because his lawyer erroneously re-applied for the P-1...which, we were informed during his interview with the US Embassy, is not valid after one has married an American citizen.

I am looking for any help or support that might be available, and would appreciate replies to that nature.

In Brazil and lots of other countries, they do indeed wait for your petition to be sent to the consulate so they can send packet 3. I don't know whether the packet is the same for K1 and K3 petitioners.

Here's what I got in mine:

- info regarding pictures;

- info regarding police records I have to get;

- DS230 (part I) and DS2001 (to be filled out by me - you can find these online);

- I134 and poverty guidelines;

- info about military, marriage certificate, death certificate or divorce decree, if applicable.

Copy of my passport and birth certificate, and one passport picture were to be sent with the DS forms.

However, the contents are different in each country. Maybe you could ask someone going through the Argentina embassy, by searching on VJ.

I only offer advice - not even legal. Just the plain and simple kind.
