Hi Everyone,

My fiance and I are just starting the whole K1 process. I'm in Canada and he's in the US. One (of the many..lol) questions that I have is can I stay with him in the US (as a visitor) while we go through this process. I understand that I would have to return up here to complete the process but I lost my job and don't feel like sitting here waiting for months to go by when I could be down there spending time with him and his family. Usually when I fly down there I don't advise that I'm going to see my fiance since I usually stay at a Casino Hotel I just say I'm going to gamble but if I go for a longer period of time there may be a red flag.

I have read conflicting online stories about this and I want to be sure I am aloud to do this before booking a flight.

Yes you can stay with him.

I visited my fiancee (now wife) for 3 months while our visa was processing. I also was very honest and said exactly my reason for visiting.

Take along your NOA1 as proof you are going the legal route.

As a Canadian you can easily "visit" the US for up to six months with no visa. A privilege few citizens of other countries have.

Having said that it's the US border agents that are tasked to deny entry to anyone coming in from Canada that in their judgment and observation may not have ties in Canada such as a house or apartment, job, bank account, utilities etc. and they can then have strong reason to believe you will be returning on the day you state.

I've been told by a US border agent "staying with someone" is not a visit.

My fiance was denied entry on her 3rd "visit" to come and see me last summer because she never had a job in Canada, or her own apartment. It appeared to them she had more reason to be "visiting" me in the US than living in Canada.

She was photographed, fingerprinted and denied entry.

She returned to the border later that day with bank account, rental agreement and other proof of ties and was photographed, fingerprinted and denied entry again. That really sucked!

We started the K1 process after that experience.

It really is up to the individual call of the border agent which you draw at the time you cross. They have a record of your previous visits/activity as to when you crossed in and came back again. Your passport and or license plate is scanned in and the information is shared by both countries. Can they determine you have been spending more time in the US than Canada lately?

The more crossings and the longer you stay or visit in a period of time will throw up a red flag depending on the answers you give to the questions they are trained to ask.

Hi-

You can go visit your fiance, especially because you just started the process. But it's not recommended when you are close to the final interview at US embassy.

I visited several time my fiancée during the process, I have been honest to the officer at airport, and I could always enter to the US.

What you shall respect to avoid some eventual problem at the airport : never lie to an officer, show him you have not the intention to stay in the USA over your visitor stay, show him some documents which prove you must come back in your country (rental home, job, school, etc).

Take time to read it - it has a list of evidence that you may want to bring with you. Nik found that NOA1 from the filing was helpful in getting him through secondary inspection on his last visit.

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.
