I am really confused. I got here with my K3 visa and now we are about to process my AOS. My understanding is that we do not need to do the medical examination again since we are going to file it before the one year expiration. I did it last March 2009. We got the I-693 from a CS and then I read something that a tuberculosis test is needed to adjust a status.

My Q is what is it really? to have the TB test or not? The nurse from the CS office called someone "her friend" working in the immigration and said we don't need to do anything but to have everything transcribed by a CS. And I've read so many post here on VJ who got RFE's regarding their medical records.

Next is that we don't have any evidence like joint accounts because we didn't file my EAD first to get the SSN. And since SSN was required by the bank for me to be added to my husband's account. Is this a ground for an RFE too? The only evidence we can show are pictures of me here (him and his family with me) and the bill from the county health department showing my name (married name). Would that be ok?

Hi all...

In preparation for the I-693 we got the required "booster" immunizations at the local health clinic then went to the Civil Surgeon. At the surgeons office they were frankly very confused about what to do even though they ostensibly do these all the time. They took copies of the immunization records, re-examined Hazel even though they said they did not need to and had no idea what to do about the T.B. test. We offered them the CD with Hazel's chest x-ray from St. Lukes but they said they had no way to read it.

For guidance on what to do the office manager at the CS office called their contact at USCIS who told them the TB test would not be necessary as USCIS has the results of the initial St. Lukes exam that we had necessarily surrendered at Hazel's Point of Entry in L.A.. *Hazel obviously HAD the TB test in Manila and passed or she wouldn't be here. * The surgeon then filled out the I-693 with notes to state that he did not do a TB test.

So...

With the one year anniversary of the initial exam fast approaching and the signed and sealed I-693 (without a TB test)...

Where does that leave us? Are we covered? Can we file NOW before the anniversary passes?

What about the CD with the chest x-ray that is marked:

"To the immigration officer:

Please give this CD

to the immigrant

for submission to the

local health department,"

Do we need to do something more with this CD?

Hi,

If you came in on a K visa, you did the medical overseas, likely with just the chest X-Ray. My understanding is if you file for the AOS within 1 year of the medical, then you won't need to do the full medical again. However, you may need to take the I-693 form and get your vaccinations transcribed by a civil surgeon (part 1 filled out by you, part 2 of vaccinations and part 5 filled out by the civil surgeon).

That being said, some people have received RFE's for the medical because of one of the following reasons:

1. The time the AOS was filed was too close to the 1 year anniversary of the medical, so they want you to redo the medical exam.

2. The I-693 was not included in the original application

3. USCIS lost/misplaced the medical part of the application

4. It was a "bogus" RFE (meant to be something else)

In terms of the TB skin test, it may be a non-issue right now if you don't have to redo the medical (I didn't get one done, and I'm praying I don't get a RFE for it). If you need to do the full medical exam, they may require it.
