Hi

I intend to marry my american fiancee this spring. I am a UK resident and we applied fo the K1 visa at the start of November and are waiting with fingers and toes crossed for an NOA2.

Anyhow, to cut a long story short I was made redundant back at the end of the summer (09) and have got into a bit of financial difficulty since. I am seriously considering bankruptcy I fear that it will affect my application for AOS after I enter the states on the k1 and marry. It wont have happened before the result of the k1 app so it sholdnt affect that stage but I am thinking ahead to the AOS application.

I appreciate help and advice from anyone who knows as I have had conflicting answers from friends.

Thanks for that it didnt really answer my question. I am not considering running out on my debts in the UK and I am not considering bankruptcy in the US. I am considering legal bankruptcy in the UK --BEFORE I move. So it is done before I enter the states on my K1

My question is does bankruptcy prejudice your AOS application? After I eneter the US, get married and apply for adjustment of status does the fact that I was made bankrupt in the UK have a bearing. Can they deny me AOS after I am married and residing in the US?

Financial status in the UK has no bearing on even the visa process to the US, let alone adjusting status from within the US.

I know a lot of ex UKers who came here broke! :lol:

yes its very frightening. But not as bad as it used to be. I lost out very bad in the housing crash and that saddled me with 30 grand taht I never even had the luxury of spending in the first place! I just need a new start and a relief from the worry. I figure if I'm gonna be leaving I might as well clear the decks.

At least if for any reason I have to return home to live in the future I will have done it legally. When you weigh it up, if you are in serious debt, it can be a better option than worrying yourself to death and have heart failure every time the phone rings

Bankruptcy does not effect either party in the AOS.....they ask CAN you support. Not, how many bills do you have. Believe me, I know. And, yes, it is possible to AOS while going through a bankruptcy....even if you are the US citizen.

One thing i would say here is that UK credit ratings in the UK are not transferrable to the US (as i found out when we opened a joint A/C in Jan. Kinda sucks for me as i have good credit here and i have to start from scratch again), so you'd be starting anew in the US with your credit rating...

1990(-ish): Family Holiday to FL. Met Nicole & family.

1990(-ish) - 1992(-ish): A few return visits

08-09/2007: Go back to FL. Meet with 'the folks' & Accept that we both 'like' each other & start dating.

02/2008 - Present: ...go back to FL again a few times.

09/2009: Propose and she says 'Yes'! :D

11/06/2009: I-129F posted to VSC

11/07/2009: I-129F received at VSC

11/09/2009: NOA1

11/13/2009: Touch

12/2009: ...back to FL once again

03/08/2010: Touch & NOA2 (119 Days)

03/11/2010: NVC have my case

03/12/2010: NVC incorrectly assigned & dispatched case to Dublin, not London!

03/18/2010: Package arrived in Dublin

03/19/2010: Ring Dublin and get case transferred to London

Thats exactly what I'm hoping for :) Mine was great too until I lost my job its a house of cards really. Best of luck in your new adventure.
