Just a background,

- I'm filing the AOS for my wife, who came to the US through a K-1 Visa.

- I'm currently unemployed.

- I'm currently living on the same house with my wife and my brother-in-law (who is a US citizen, and make enough money to cover the 125% poverty line)

Following are the questions that I have

** Question 23: My individual annual Salary is:

--> Since I'm unemployed, what do I write?

I have a few options:

a) I received a bonus that was paid this year

b) My estimated unemployment benefits for this year

When I add them up, it is enough to cover the 125% poverty line. Will that be enough?

Would you suggest to include a letter?

** Question 24: My household income is...

Because I'm currently unemployed, I can't prove that I will have a steady income.

I'm inclined to add my brother-in-law's income, and have him file the Form I-864A (Contract between the Sponsor and Household Member)

** Question 25: Federal Income Tax ...

I have not filed for Tax Year 2009 yet, only up to 2008.

Will the officer look negatively on my request, or can I argue that the deadline for Tax Year 2009 is not due yet?

I was thinking of submitting up to 2008. When we go to the interview, we would take the 2009 tax return in case we need it.

Any help or suggestions is appreciated.

Its got to be enough to cover 125% for the FOUR people living in the house. Not just you and your wife. If it is not the 125% then I would go ahead and get a co sponsor.

Don't worry about filing 2009 taxes yet they won't look bad on you for it. As long as they are filed by April 15th. And take a copy of 2009 with you on your interview!

AOS Process

May 29th 2008- AOS/EAD/I-130 Sent to Chicaogo Lock Box sent via Overnight Delivery

June 6th - Both checks cashed!!

June 25th - Biometrics appointment

Sept. 19th - Card Production Ordered! (113 days since filing)

Sept. 25th - EAD Received!!!

Dec. 5th 2008 - Received appointment letter

Feb. 4th 2009 - AOS Interview (Interviewer says going to recommend for approval)

May 15th- called and talked to an officer to submit a service request

June 10th- Made an infopass appointment,

June 15th- Info pass appointment, told me they could do nothing until the officer made their decision!

June 27 - Filed for I-131 as well as renewal of my work authorization.

July 23rd- Received I-131

Dec 22, 2009 - Biometrics appointment yet again.

January 21, 2010 Second interview

January 22nd - I-485 Touched

January 27th - Received a Request for additonal evidence.

May 27 I-485 Approved

June 13th 2010 - Green card received!
