Hi guys,

First and foremost good news my husband and I were approved on Tuesday and I am receiving my conditional green card. Whoooo!!!!!!!!!!!

now on to my question. My husband was kind enough to be the sponsor for my brother, he married a US citizen. However, my brother's wife does not meet the income requirement which is why my husband is helping out by being the joint sponsor. We are trying to fill out the I-864 form and we know that both my husband and my brother's wife have to fill out the I-864, she as the sponsor and my husband as the joint sponsor. Where we are confused is part 3 it asks "are you sponsoring the principal immigrant above?" my husband chose yes. However, what does my brother's wife choose if her income does not meet the poverty guideline, does she still have to fill everything out as if she were sponsoring. or does she choose no? thanks for your help.

The US citizen spouse is always the primary sponsor regardless of income. Your sister in law marks line 8 "Yes" as well.

She completes the form and supplies all supporting documents. Your husband does the same for his I-864.

thanks so much, as far as supporting documents. She has never filed taxes so do you think pay stubs will suffice?
