Hello,

I'm traveling to Mexico due a family emergency (my sister is very sick) on Advance Parol while AOS is pending. I called USCIS 800 # and i requested to expedite my AP, the person that answered my call was very nice and i got the approval notice on my e-mail next day, so I'm just waiting to get the document on the mail. But i have a concern, what is going to happen with my AOS while I'm out of the country, I'm planning to be at least 3 weeks in Mexico. I have a B1/B2 visa and it expires in 5 years. My husband is going to be here in case we get the interview appointment. Also, do you know how long takes to get the interview appointment after the biometrics?

- We sent documents/forms on Nov 27th 2009

- We got NOA in Dec 7 2009

- Had my biometrics on Jan 19th 2010

Imelda,

If you leave before you receive the AP, then you will not be able to re-enter the US and your AOS petition is forfeited. After you receive your AP, then you can leave and re-enter the US. The USCIS will continue to process your AOS while you are in Mexico. You may not have to schedule an interview. Some petitioners do not have to schedule an interview...their paperwork is sent directly to the Visa Center. You can reschedule an interview if you can not make the first one. I don't know how long it takes to schedule an interview after your biometrics.

First off, if you want to have your AP expedited, due to family emergency, then go to your local office, with the approval notice, after making an INFOPASS appointment, and they'll give you an expedited AP that day I suspect. Also if your sisters doctor can email or fax a copy of a letter outlining the emergency.

You've had your biometrics so don't worry about that. You'll be in touch with someone here I suspect? If you get an interview, it will probably be a month or so down the road if you haven't heard already. Or, your file may be transferred to CSC which means you won't be getting an interview.

If you get a letter while you're away, and it says you have an interview date on such and such date, and you'll still be in Mexico at that time, you'd best make plans to get back for that date. Don't try and reschedule that interview date.

Now that you've gotten a K-1 visa, and you're in the process of Adjusting Status, I don't think B-1's or B-2's are even valid anymore. You can't have two visas at the same time.

Again, you've stated that your husband is staying here, so he can let you know if he hears about an interview date.

Just couple more questions.

- Do i need to give back my I-94 when i leave the country?

- When i come back from Mexico am I goning to get another I-94 at the port of entry?

- On the I-94 form what do i need to write on "country where do you live"? US?, City where visa was issued?, date issued? Do i need to use my married name?

- Besides AP, Passport and Marriage Certificate which other document do i need to brng with me?

They will probably ask for it.

They will stamp your AP and your 94 with the parole stamp.

Your current US address - use the data from the AP for the "visa" info, since you are using the AP in liu. (use the name which is on the AP)

That should be it - however, for note, only the AP is used to enter the US, not the passport (you can still use it as an ID, of course)

Moved from K-1 to W&T prior to getting GC

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
