Follow to join after one year?

Hi when I petitioned my wife she also put her son's name on the I-130 to come or follow to join soon after. At the time I was laid off and could not afford for him to come with her:-(. So anyway now we both are working, it has been a little over a year since she came to US, do we have to re-petition him or can he come right away since he was on the I-130 to come with her or follow to join? Thank for any info:-)

There is no follow to join priviledge on an I-130 for a spouse. The child needs their own approved I-130 for a CR2 visa.

Facts are cheap...knowing how to use them is precious...

Ok but I remeber the child could of came with her at the same time or within so many months he could of came after she came, am I right? Or is it at the time of actually doing the paper work I said I will only petition her becuse of x amount of yearly income? does that make sense?

You remembered something that doesn't apply to your situation. For CR1 and CR2, each intending immigrant needs their own approved I-130 petition. Financial documents and qualification come after the petition is approved and joint sponsors are allowed. You can file both petitions at once or separately but the marriage must occur before the child's 18th birthday and they must obtain the visa and enter the USA before turning 21. There is no time limit between when the parent and child immigrate for a CR1/CR2 case.
