Hi everyone - I'm new to this forum but it seems great to me. I'm actually writing on behalf of my american fiance (my job allows me more time on my hands!!). Ok - so the story is that we started talking on the internet in September 2004 as he was moving to England (where I live and i am a citizen of) as he is in the US airforce and his new base was there! We officially met in October 2004, got together in Feb 2005 and I moved away from London in Jan 2006 and we are currently living together. We have not been apart from each other for more than 2 weeks in the nearly 2 years we've know each other. It's now time for him to move back to the states as he'll be stationed in Arizona. Of course I want to join him over there. I have no doubt that our case is very strong but i just need some advise. He is due to start in his new base in November. I'll be travelling the month of October/November to central america to learn spanish as i realise that in Tucson, i will definatly need some spanish skills in order to get a job! November 19th I'll be flying to Tucson from Costa Rica and will be staying until Feb 14th (as i'm a british citizen i will not need a tourist visa). This is just so i can get a feel of the states and have a little rest from working, plus i want to be near my man!! Is it possible for him to start the process of the K-1 visa whilst I am in the states? I hear that it can take from 3 - 8 months to be processed. Once I am back in the UK i will then work until i get my visa (however if it takes a really long time is it possible for me to fly over for a couple of weeks to see him every now and again?). Now my questions about the application? When i was 18 (i'm now 24) i stupidly got married to a Tanzanian guy (more like tricked into it) - we are now divorced but will this affect my application? For the evidence that we have met we have 1000's photos but we dont have that many emails and phone call logs etc as we have lived together for the last 8 months, what else can i bring? All the bills for our house are in his name! Sorry for a long story but i have so many questions!!! Thanks

First of all your case sounds very straight forward.

Check the quides here on the board (listed above as FAQs and guides).

Since he isnt leaving the UK until fall, I believe he can file using direct consular filing, but check under this site for confirmation.

USCIS

As long as you have divorce papers from your prior marriage, there is no problem.

Traveling on the VWP program while awaiting can be an issue but as long as you evidence of need to return to UK shouldnt be an issue.

The pictures and evidence of him living in UK while stationed there should be sufficient evidence for approval of petition. You only have prove ongoing relationship at time of your interview. Petition only requires you to have met once in the last 2 years.

On a K-1 visa you will have to be married within 90 days of entering US on the visa.

Welcome to VJ. You will find a lot of very helpful people here and we look forward to seeing your posts in the future.

Yes, you can submit the I-129F application while you are here in the U.S., but you will need to return to your home country for your medical exam and interview.

As for visiting while the K-1 Visa process is underway, you will need to show strong ties to your home country when you enter the U.S. to prove that you will return to your country after your visit. You can bring along such things as your most recent pay stubs and lease/mortgage documents.

Your prior marriage will not be a problem as long as you have your divorce papers.
