I-864 question....

Now that the new year has come we're wondering if the most recent tax return year is 2009? When we file should it be for 2006-2008 or 2007-2009? My husband has not got his W2's yet and we are afraid we'll have to wait till the middle of February (at least) to get his documents :( And one more thing... if we provide tax transcripts is that enough prove? I mean he does not keep his old W2's or any other tax documents...

We are also using a sponsor - my mother in law but she and her husband own a business and file for tax together. My husband said it doesn't show anywhere what their individual income is? What should we do in that case?

I was going to call NVC and ask these questions but all I get for the last 2 days is busy tone (and so does my husband) :(

05/13/2009 - I-130 sent to USCIS

05/15/2009 - check was cashed

05/19/2009 - NOA1

11/05/2009 - RFE - signature missing.... duh!

12/18/2009 - NOA2

12/18/2009 - NVC case number asigned

12/23/2009 - AOS bill & DS-3032 generated

12/25/2009 - DS-3032 emailed (didn't go through)

12/28/2009 - AOS bill payed online

12/29/2009 - DS-3032 emailed again...

01/10/2010 - IV bill paid online

05/06/2010 - AOS package sent

05/13/2010 - IV package sent

05/25/2010 - AOS package received by NVC

Timeline

Line 22 on the parents 1040 tax return is the amount that is evaluated.

They will also need to include the Schedule C from their tax return. (page 8 of the I-864 instructions)

If your husband does not keep his old W2's (not advisable) then he will have to obtain the IRS transcripts. If not then he would need to get copies of the W2 from his employer(s).

Depending on when your I-864 is submitted your husband's 2009 tax return may be requested.

we have the same question in mind about whether to use 2006-2008 or 2007-2009. i've decided to just send them 2007-2009. why? because i did not meet the income guideline for 2008....but i met the income guideline for 2009. so far, no response yet from nvc though.

Ok, I just called NVC (after 18037 tries) and they said they won't request tax returns for 2009 until after April which is a great news for me (F) now all we have to do is file I864 without a mistake and we'll hopefully be done with the NVC by the same time next month :) woo-hoo!
