I filed a K1 Visa Petition in Jan 2007, and it was approved. Circumstances changed, and we did not continue the process. We are in a different place, and want to try again. It has been more than 2 years, I was wondering if I answer "yes" to question #11 on the form.... or "no". It is the same Fiance.

The instructions for the form state:

"If you have filed two or more K-1 visa petitions at any time in the past or previously had a K-1 visa petition approved within two years prior to the filing of this petition, you must apply for a waiver. To request a waiver you must submit a written request with this petition accompanied by documentation of your claim to the waiver."

So I do not believe I have to file a WAIVER, but dont know if I should answer yes or no....

It says 'have you EVER' so the answer is yes.

yup, do a waiver letter, it's no big deal, just write out a nice little letter and explain what happened and ask for a waiver. They will understand.
