J1 waiver from Chinese embassy

Hello,

I need help from chinese members here. My friend is an exchange scholar from China. She's on J1 visa which is subjected to 2-Year Rule. and now she and her boyfriend want to get married so he's working on filing for K1 visa for her now.

But the problem is that she heard from somewhere that to marry an american is not an eligible reason to ask for the No-Objection Statement from the Chinese embassy, she siad, for a Chinese citizen, if the reason is for K1 visa, the posibility to get the waiver is only 1%

Is this true?

Most likely.

Not because it's for a K-1, but because they (Chinese government) may want her to fulfill the requirements of the J-1.

(who paid for the education btw?)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

She paid her own expenses, the Chinese goverment didn't finance her or anything, but her university in Shianghi permited her to come here to do research at University of Michigan. So no one pay for her, but she requested Shianghi University for a permission to come here and gain more educational experience or something like that. Any advice please?

Only advice I can give is to file for the waiver and hope for the best.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Thank you Bobby&Umit for the reply. She's still in here in the US but she will have to go back to China in March, so must she request for the NOS while she's still here or when she's already back home?

It appears you can start it now.
