Hello

I want to sponsor a Fiance but i got a question. I have a criminal record of which is a stalking charge. It happened 11 years ago and i took a plea to get out of jail and also to avoid uncertainty. So what are your people's thoughts regarding my chance of being denial? I phoned a lawyer and she told me that it shouldn't be a problem but what are your peoples thoughts...would it be a serious issue ...or nonissue. thanks

A lawyer can advise you better than we can, but all you can do is report it when asked on the I 129f and go from there. Read the instructions on the I 129f - it should tell you what other documentation you'd need to include in lieu of this.

And be sure to disclose it each and every time you are asked on any forms.

This is not a reason for denial but you'll need to provide the court records so your fiancee can be fully informed.

Facts are cheap...knowing how to use them is precious...

thanks for the reply. yes i will have to provide sealed court record but I'm thinking that if my chance is slim or none then i would rather not waste time and money but if its a nonissue , i plan to go ahead with the process. my feeling as of the moment is that it shouldnt be an issue as long as i explain the situation and provide sealed record if needed

Hi me too had the same probem...my fiancee had a criminal record but not same as yours. He provided me a copy on his case and we also discuss about it. During my interview, it did come up and the consulate asked me about the case and I said "Yes, i know all about my fiancee's case and its been 10 years ago. I do believe that he had changed a lot now." In the end, i pass the interview and got the visa.. Just make sure ur filipina fiancee is well informed so she knows what to answer during interview...Dont give up...

I don't think either of us are saying it's a 'non issue', but rather, that it's not a likely reason that a petition (or visa) would be denied.

I was far more definite. It is NOT a reason for denial. A USC on parole for armed robbery can get a petition approved. Unless the crime comes under the Adam Walsh act (sex crimes against children) a USC's petition will not be denied because of it. Lying about any crime can get you denied though.

The OP only has to disclose this record because it is covered under IMBRA. IMBRA is about informing the fiancee, not about denying petitions.
