This is definitely a clerical error. I just wonder how successful others have been in resolving such errors. Here's the story:

In April 2008, after waiting almost 3 years, my husband received a 2-year conditional GC. Since we had been married more than 2 years at the time, we filed form I-90 citing an administrative error and requesting a 10-year GC. In October 2008, my husband finally received the 10-year green card and everything is fine.

One thing to note is that we had a change of address a couple of years ago and we notified USCIS of the change. Since my brother lives at our old address, we were able to get any mail that continued to come there.

Then today my husband received a letter from the Vermont office addressed to our OLD address stating that their records "indicate that you entered the Untied States as a conditional permanent resident on 4/08/2008." And that he needs to file Form I-751 to remove conditions on residence. Of course, my husband did not enter the US on that date but rather that's the date they approved his conditional GC in error.

I will try calling them tomorrow but I'm thinking I might need an Infopass appointment to straighten this out.

Yep schedule an info pass appointment ASAP!

AOS Process

May 29th 2008- AOS/EAD/I-130 Sent to Chicaogo Lock Box sent via Overnight Delivery

June 6th - Both checks cashed!!

June 25th - Biometrics appointment

Sept. 19th - Card Production Ordered! (113 days since filing)

Sept. 25th - EAD Received!!!

Dec. 5th 2008 - Received appointment letter

Feb. 4th 2009 - AOS Interview (Interviewer says going to recommend for approval)

May 15th- called and talked to an officer to submit a service request

June 10th- Made an infopass appointment,

June 15th- Info pass appointment, told me they could do nothing until the officer made their decision!

June 27 - Filed for I-131 as well as renewal of my work authorization.

July 23rd- Received I-131

Dec 22, 2009 - Biometrics appointment yet again.

January 21, 2010 Second interview

January 22nd - I-485 Touched

January 27th - Received a Request for additonal evidence.

May 27 I-485 Approved

June 13th 2010 - Green card received!

I would too - better to get it worked out now than to find out later there was a problem. It is important that USCIS's records match the PR/Green Card.

When I called the 800 number, I was told to send a certified letter explaining the situation, along with a copy of the GC, to the Vermont office. I would be able to call back in about 30 - 45 days to verify that the issue was resolved.

However, I have made an Infopass appt. for 1/8/10. I'm not sure if I should send the letter as well.

At the Infopass appointment today we were told that the Vermont Service Center never updated their records and we should give them up to 60 days (after sending them a certified letter a couple of weeks ago) to update their records. Also, this error has no bearing on the validity of the GC.

One interesting thing to note is that we were pleasantly surprised at the efficient service at the NYC office. We waited about 10 minutes before our number was called and the officer was extremely polite and helpful. Before we left we were given a customer satisfaction survey to complete. The entire experience was very pleasant and less bureaucratic than in the past.
