K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Is your husband the father of your kids? Are the kids filipino? If your husband is not the father of your kids.. he can file an I-130 petition for your kids being his stepchildren. Thats what my husband did for my 2 kids now.

How old is your son? Did you marry your husband before your child's 18th birthday. Did you arrive to the US as a fiancee (K-1 visa) or on a visa for a spouse?

Give us more details about you and your son, so we can give you information that is relevant for you. There are many different situations and each has its own answers.

Is your husband the father of your kids? Are the kids filipino? If your husband is not the father of your kids.. he can file an I-130 petition for your kids being his stepchildren. Thats what my husband did for my 2 kids now.

USC husband can file I-130s for the kids if they are unmarried and the marriage to mom occurred before their 18th birthday. If they meet both requirements, then it should take about 6-12 months for the kids to get visas.

Read the guide here about the I-130. Yes your husband can file an I-130 petition for your 10 yr. old son. We just filed last April and got approved this month.
