Timeline

I'm currently employed with the same company for the passed 3+years, but my status with the company is on-call (I was full time, but I had to take a medical leave of absence for 5 months and was rehired as on-call) . I work anywhere from 24 to 40 hours a week depending how busy it is. With the recession being what it is, it is very hard to get back to full time status with our company. I make close to $50,000 a year so Im way above the poverty line. My concern and question is will they frown on my on-call status? Or is there primary concern the income level? I read on the I-134 instructions #3 Whether the position is temporary or permanant. Might they view on-call as a temporary position? Like I said I have been with company over 3 years now and 2 since my LOA.

I think they'd look at your total salary made more than anything else. You've been there a long time so I don't see how they'd view it as temporary.

Well i can show how much I make, with paystubs, W-2's and tax returns and a journal of all my tips. Im just hoping they wont say denied without giving me a chance to present all my evidence.

I'd also think they only care about your total salary and they wouldn't care if you work less than 40 hours or if you were on call or not.

I think the goal of evidence of support is to show above poverty level and reliable income.

K1 timeline :

1/11/10 - I-129F sent to California Service Center

1/19/10 - NOA1

2/18/10 - moved and changed address on USCIS site

2/19/10 - touched

3/10/10 - touched

3/10/10 - NOA2, hardcopy recieved 3/12

3/16/10 - Left NVC, recieved MNL case #

3/22/10 - USEM recieved

4/19/10 - Passed Medical

4/28/10 - Interview - Approved

4/30/10 - Picked up Visa and completed CFO

5/5/10 - POE - Honolulu, Hawaii

5/6/10 - married in Hawaii

AOS timeline:

7/8/10 - received SSN Card

7/16/10 - reported US marriage for RP records

10/18/10 - AOS delivered in Chicago

10/25/10 - NOA1

11/04/10 - Biometrics Letter Received

11/23/10 - Biometrics Completed

11/24/10 - touched

11/26/10 - touched

02/14/11 - AOS approved at Interview, GC ordered

02/22/11 - GC arrives in mail

ROC Timeline:

12/17/12 - I-751 sent to California Service Center

12/20/12 - NOA1 arrives in mail

1/14/13 - Biometrics appointment

4/11/13 - RC Approved at Interview

4/22/13 - 10 Year Green Card arrived in mail

Ditto... They just want to make sure you earn enough to support your SO when they enter the country, whether you do that working 1 hour or 80 hours and whatever your "official" status is... You show steady income and are with the same company... You should be fine

You will present your finical at the time of the interview, that’s when you’ll have your chance. I think your fine....

Ok I guess I will try not to worry about it much then, I would hate to fail knowing that I make way above their standards.

No one prepares to fail they just fail to prepare, if your ducks are in a row your good to go! Remember its the ‘totality’ that counts, not just one part of the process.

You have a lot less to worry about than I do. I only make 9 dollars an hour for 40 hours a week but I have a reliable co-sponsor.

According to this calculator you make around 171% of the FPL. I thought I've read somewhere on VJ that they only require you to be at 125%.

The requirement for K-1 is actually 100%. But anything put on the I-134 is not a necessary indicator that she will become a burden to taxpayer dollars. But it seems the consulates rule in a case by case basis which is quite unfair. Everyone should get the same treatment.

The joke of the matter is that they let Mexicans flow freely over the border...and they're a heavy burden to our country, we give them visas, amnesty and whatever else thrown their way. But God forbid the Filipina fiance of an American might become a burden to taxpayers...yeah right.

Why does the US Goverment turn a blind eye to the over 12 millions Illegal Aliens that have crossed over the border from the south.

I am hoping this is the case, but if you derived income some weird way like professional gambler. You would probably have a tough time getting a letter from your employer.

No letter they would be considered ‘self employed ’ their options would be to submit plus or minus, the same documents as a employer based, employee.
