Hey,

the NVC send a Mail to my husband. We must failed a Form I-864W for our daughter.

She is 12 years old. Why must we to that? She have a german-passport.

Marriage - Februar 1997

12/10/08 - I-130

07/08/09 - I-130 was approved

08/04/09 - DS-3032

08/05/09 - DS-3032 send to the NVC

08/10/09 - AOS paid

08/31/09 - IV-paid

09/30/09 - Medical in Leipzig

10/05/09 - DS-230 send to the NVC

10/23/09 - RFE from NVC

11/10/09 - RFE sent back to NVC

12/09 - RFE - I-864

01/10/10 - RFE sent back to NVC

01/25/10 - Logg in failed to NVC

03/04/10 - Interview in Frankfurt

More information is needed to give good advice. Where are you in your process? Are you in the US? I'm thinking that you need the I-864 for her and maybe your visa.

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

Sorry, we are paid and send the DS-230 to the NVC. My husband send the I-864 to the NVC.

I life at the time in Germany with my daughter and my husband is in the USA.

The process starts in the USA.

Is your husband a United States Citizen? Is so, they are asking for the form I-864W for you daughter because, if she is the daughter of a USC, according to the Child Citizenship Act of 2000 allows certain foreign-born, biological and adopted children of American citizens to acquire American citizenship automatically once they become a LPR and enters the United States therefor your daughter is exempt from the Form I-864 requirements, and the I-864W has to be sent instead of the I-864 (applies only for your daughter)

Hello, The form I-864W is only an "exemption" from the affidavit of support. Since your daughter will get the US citizenship automatically she'll meet the requirements for an exemption.

Intending immigrant is a child who will become a U.S. citizen immediately upon entry under the Child Citizenship Act of 2000 (CCA). Under the CCA, some children become U.S. citizens immediately upon admission to the United States or adjustment of status to that of a lawful permanent resident. For this classification to apply:

At least one parent of the child is a U.S. citizen;

The child is under 18 years of age at the time of admission or adjustment of status;

The child is residing permanently in the United States in the legal and physical custody of the U.S. parent; and
