Here is my situation. My fiance is divorced. I have copies of her birth certificate and her divorce certificate. She currently uses her married name so it is the same as her 17 year old son. She is having problems getting a copy of her marriage certificate. Her maiden name and her married name are listed on the birth certificate and divorce certificate respectively. Do I need her marriage certificate?

Yes, because you need to provide a copy of the document that "legally" changed her name from A to B.... but this will be to the consulate and not to the USCIS. The USCIS only need the divorce decree.

Yes, because you need to provide a copy of the document that "legally" changed her name from A to B.... but this will be to the consulate and not to the USCIS. The USCIS only need the divorce decree.

also better to get all ready for next steps and have on file. more info is always better than not enough info and have to find at very bad time and cause delays

We will have the marriage certificate in plenty of time for the interview. I just didn't want to hold up filing the 129f if I didn't have to. In the guide it said all documents pertaining to name change should be filed with the 129f.

In the case mentioned, the only document being submitted to the USCIS for the petition for the beneficiary (copy of divorce certificate) shows both her maiden name and married name. In this case with only one name change and both names listed on the divorce certificate, the divorce certificate would be sufficient. It is true, in some cases the marriage (or name change) certificate could be needed for the petition. I believe in the OPs case this is not true. He WILL need the marriage or name change certificates for the interview in any case.
