Dear VJers....I don't know what to do with my case being delayed. Here is my timeline:

1. May 28, 2009 - USCIS received our I 129 F

2. Aug 28, 2009 - RFE (evidence of meeting)

3. Sept 10, 2009 - USCIS received RFE response and case processing resumed

4. Nov 2, 2009 - Made an inquiry for our case

5. Nov 9 - USCIS sent me an email that our "background check remains open......"

6. Nov 10 - Touch

..............................................

It has been more than 6 months from our NOA 1.... and 3 months since we received the RFE and nothing yet. I see that everyone with my date of RFE has been already approved but not our case...

Do you think they have lost my case or what else could be the problem?

To me, this stands out as a primary explanation for the delay.

You may want to think about what they may have found in your background check. Are there any crimes or outstanding warrants they may have come across? Hopefully the November touch means they finally have what they need and can proceed. :unsure:

For God's Sake! I have no crime record, never ever had a police record for anything.... No worries for the background check at all....

Having a criminal record (or not) isn't necessarily what holds up a background check. Could be common name, particular name - or combinations of name and other data. Not a whole lot can be done - you're definitely past the normal ranges - unfortunate to put it mildly (am sure you feel that way too). If it continues much longer, you may consider contacting one of your Senators or Congressman. Hopefully it resolves itself soon.
