Timeline

hey guys...

(Aussie married to a USC, trying to get my AOS together! entered US on a J-1 visa and im not submitted to the 2 year thing)

so my "Not-so-up-to-date-with-my-taxes" husband just filed his taxes for 08. (nov 18th)

We need copies of the IRS transcript to support the I-864.

The IRS informed us it would take 6-8 weeks for it be filed and returned, however we have a stamped copy of the 1040 from the Atlanta IRS office, will this be sufficient to submit along with the W2?

has anyone else been in this hick-up? we definately meet the poverty line requirments, so thats not a bother, i just dont want to submit the AOS packet only to have it returned.

Im getting way to anxious on this whole AOS thingy, and not being able to work is killing me!!

Also...

on the app for travel I-131,

this is the form used for me to travel out of the US during this visa process and GC right?

do i only fill out parts 1,2,3, 7 & 8?

it seems simple, but im going nuts with this form for some reason!

ive had people help and advise before... but this is crunch time!! i need to get this done.

thank you in advance if your able to shed more light onto this for me!

I-864 : I think you're more than likely to get an RFE than the whole package being sent back, maybe just write a cover letter stating that you have applied for the docs and will send them in when requested - they might even only ask you for this at the interview stage.. but don't quote me on this!

Yes, Advanced Parole is so that you can travel while waiting for the GC, most people put off travelling until after they have their GC in hand, depending on how bad the emergency is, it's worth at least trying to get the AP though, in case this process does take very long and someone back home gets very ill or something. But they treat each case differently and I think it's not a guarantee that you'll get approved just by applying for it, you have to write a letter explaining why you need it so bad.

For the tax thing I don't have a 100% answer, but would also guess that you would likely get a RFE instead of the whole package denied.

For the Advanced Parole I did not write any letter and got approved with no problem.

I filled out Number 1, 2 (option d), 3 (1. Multiple 2.Varying lenghts --> this is what you can fill in when you don't really have a planned trip, but want the AP "just in case" 3. check "No"), 7 (check "More than one trip"). Then signed and dated it and filled in my phone number in Part 8, that's it.

So yes, you only fill out 1,2,3,7 and 8.

Include a copy of the passport page with the J-1 via and the biographic page, copies of the I-94 front and back, copy of the marriage certificate (I did it to show my married name, still have the passport in maiden name) and 2 passport style photos of yourself.

This is the easiest of all the AOS forms in my opinion. Should not be a problem!
