I entered the US (with a minor child) using the K1/K2 Visa. My fiance and I married and filed for the I 485 (Adjustment of Status) within days of arrival. We were called for biometrics and went yesterday. The counterstaffperson told me that next, I would either get called for an interview or get my green card in the mail. She could not give me any more info.

My questions are:

1. My medical check-up: I had one prior to coming to the US by a doctor that was registered with the US Embassy. Do I need to have another USCIS surgeon do another check-up here in the US? The initial doctor used DS 3025 which was accepted by the US Embassy and the Immigration officer at the point of entry. Do I need another doctor to do I 693? Do I wait for instructions from USCIS or do I go ahead and get it done?

2. My K1 visa has an expiry date of Mid-Dec 2009. Do I have to go and get the visa renewed while waiting for the green card or am I ok to stay while waiting for the approval/green card?

1. No. A medical within one year and the DS 3025 should be all you need. If you need any other vaccinations you can get them at a local health department or family doctor and send the records to the CS Dr. Arnold, in Texas for verification. If you have had all your vaccinations...no worries.

2. Your K1 was cancelled when you entered. K1s do not "expire" they are killed at POE. The "expiration" date is the date which you must use the visa to enter the US by. You do not need to apply for anything else.

I presume you filed a separate I-485 for your daughter, yes? You know she needs a separate filing and fee and all necessary papers for the AOS just as for you. If she is under 14 and files with you, the fee is $600. You didn't mention her and usually when filed together you will go to biometrics about the same time, etc. (If she is under 14 she will not have biometrics)

I'm sorry... I'm misunderstanding you... I'm not sure what your 'NO' was referencing. So I DO need another medical from a local doctor then. And I CAN go ahead and do this without direction from the USCIS (no official letter received). I'll do a search on where to send the I 693. I'll write back if I get stuck.

Yes, my minor child has his own I 485 application (with the $600 fee) and got his biometrics done at the same time as I did.

The reason why I ask about the visa extension is that while we were living in a South East Asian country, he had to get his visa renewed every six months. But it seems that here, if I understand you correctly, while our application is being processed, we can just stay and not keep extending our papers with immigration.

Many thanks for your input!!!
