Hi, we are in the process of sending the I-864 form. Here is the situation. My husband earned about $23k (gross) for past 3 years. So basically his income is more than the poverty line since only him and me are the household members. The thing is, early this year, he resigned to his job last January and went to the Philippines for us to get married in church (we were married in civil on 2002). Now, he is back to the US and to his old job and he just started working this October. He already got his 2nd paycheck.

The thing is his gross income for this year is only $4k and nowhere near the poverty line. But he maintained his seniority in his job (employed November of 2005). In paycheck, it shows his current pay and the year to date summaries. So they will surely see his income this year.

So my questions are:

1. Is he enough to sponsor me? What should we do in this situation?

2. His work uses an online employment verification system ( http://www.theworknumber.com/Verifiers/) . There is an instruction on how to verify his employment but he will be needing to login there and check it for himself. If we only send the instruction, will the immigration officer use this to verify his employment?

3. Lets say there's no one to co-sponsor us. We'll he be OK to sponsor me by himself?

4. My husband voluntarily opt in to withheld is salary ($50 per pay) in his w2 so that he can get more refund in the income tax return. He payed at least $6700 (federal, medicare, SSS and IL state income deducted from gross) and got income tax refunded by $2500 in 2007 and 2008. And the net pay shows he only earned $16588 in 2008 and $16956.95 in 2007. Will the income tax return counts as an income?

Mar. 27, 2010 : received a WELCOME Letter and my Greencard.. Yay!

Apr. 03, 2010 : received my SSA Card.. finally!

So he's back to his previous salary - his pay-stubs will prove this and he has a tax-history to show stability. Sounds good to me.

Probably not. Best to get that verification for yourself to turn in or drop it since its not a real necessity.

Nothing you've said would indicate a huge issue. Some things are consulate specific but even for USEM it doesn't sound alarming.

Thanks so much. That helps us a lot on deciding if we will send our form ASAP or not. Since I don't want them to see my husbands 2009 Income tax return :P . So we'll just be sending all the necessary documents and good luck to us :) . Thanks again :) .
