I am in Colombia now and about to petition for my fiance to come to NYC. I am working for an outsource company in colombia right now, therefor, all my financial support papers will be from colombia and from last years I have 1040.

My question is, what kind of affidavit of support should I provide if I am working in colombia with an outsourcing company from NYC and if another person different to myself could provide this affidavit of support?

Which is the easiest path to take in order to bring my fiance to the states and marry upon arrival. Or is it best to marry in colombia and then file petition?

Follow the K1 guide. The affidavit of support is not filed with the petition. It's carried to the interview at the end of the visa process. You'll provide one as primary sponsor. If you don't qualify, you provide the same affidavit (I-134) from a cosponsor who does qualify.

How long have you been in Columbia, are you going to stay much longer and what are your reasons for going back? I'm not knowledgeable of the visa process from Columbia, but might DCF (Direct Consular Filing) be a better option? i.e. You get married in Columbia, file for a DCF for your now wife and then either transfer back to the US with your company or start trying to get yourself re-established in the US with home, job, etc.

Have you maintained residence in the States during your time away, depending on how long you've been gone. This can include having bank accounts, health insurance, etc.

Have a read of the DCF, CR1 and K1 process in the guides here and make a decision based on where you are, when you're leaving and how easily you can evidence supporting her from within the US.

Married: 17 July 2010

AOS mailed - Interview : 22 November 2010 - 10 March 2011

ROC mailed - approved: 14 February - 18 June 2013

Citizenship mailed - ceremony: 9 February - 7 June 2017
