Ok.. I have a quick question.. I have to use a co-sponsor to help me in getting my fiance here and his 2008 tax returns have 3 children on it who he is no longer responsible for.. Therefore I am getting a letter from the childrens mother stating he is no longer responsible.. Ok what I am needing to know is what does that paper need to say? How should we lay it out to show to the consulate? Any help is appreciated!

Date it the date of the intervieww or close to it.

You seem to be confusing tax returns with affdavits of support. If the children are his and the children are under 18, or under age 23 and students they count in his family size. The mother cannot "relieve him" of responsibility unless he surrenders all parental rights and has court evidence of such. Check the guides about family size and children. It does not matter where they reside or who claims them on taxes, they are his responsibility as "wholly dependent" until they are age 18 or there is a court order otherwise. Taking them off his tax return only gives a big tax benefit to someone else and nothing to him.

USCIS and he State Department do not care who gets a tax break.

There is a simple reason for this. The US government wants to get their money back if you go on public aid. They want a way to get it, most often by garnishing someone's income. They are prevented from taking more money than a family needs to live (125% of the poverty level) If he says "I ahve no children" and they calculate his family size at TWO and then you go on welfare and they try to collect, he is going to say "But I have children" WOW, where did they come from? You see. It is all about the government covering their own butts. Children do not evaporate because of divorce or where they move to, he cannot just wave a pen and remove his responsibility, his ex-wife cannot just say "OK I will take the tax deduction" and they go away.

I have asked you about this before and you instructed me to do the letter im sure u dont remember lol I really appreciate ur help.. My co sponsor claimed his step daughters children last year bc she was having some problems so he took care of them.. but she has them now.. I should have been clearer in my previous post

OK, yes, I remember now, and such is the case because they are not his children. Then in that case, yes, a letter to explain the situation. There is no particular format. Please try to be clear that they are NOT his children.
