Wife's CR-1 interview next month. Her son is coming with her.

I'm very confused right now. My wife's son or my step son's name is included in I-130 I filed for my wife. My lawyer didn't tell me that I need to file I-130 for the son too. Is this true? what are my options at this point?

Please advice what to do here...thanks in advance

you subject says CR1 but you profile says K3, which one are you going for?

CR1 doesn't have any derivative status. You need to file I130 for your step son.

My profile is old. I'm going for CR-1 based on my lawyers mistake. I wanted to go for K-3 but since she got the interview date for CR-1 and I assume that my K-3 is not valid anymore. I had lawyer and they didn't tell me about this and I found out today that I need to file I-130 for my step son...it is going to add few months to my wait.

You have to do the same steps for your step son as you did for your wife.

Can I still go with the K3? Do I still have that choice?

I'm not sure. Have you contacted NVC or the embassy to find out?

contact NVC. K3 approval is valid for 1 year. You might still be able to switch to K3. If your lawyer included your step-son's petition with the K3, he can come over with the mom. But if not, he gotta go through the whole process again on his own. You might want to find somebody to take care of him while he is in his home country while the new petition is being processed.
