Hi --

My question has to do with the legal weight of the affidavit of support for student visas. I know that in the case of a finance visa the sponsorship form (I-134) has very legal weight, whereas the affidavit of support filed in the case of the AOS (I-845) is quite strong legally. What I am wonder is whether the affidavit of support filed in the case of student visas is legally weak or strong. Does anybody have any idea?

Affidavit of support is an affidavit of support. If you intend on trying to collect government support, the person who sponserd you on the affidavit will, in full, pay back every penny that you take out of the government. The I-845 is a legal binding document.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

I am a Citizen of the United States of America. 04/16/13

Does one fill out an I-845 for a student visa? I don't plan on needing government support obviously. My concern is more with communicating accurate information to a potential co-sponsor as to the financial/legal obligations incurred.

You'll need to research whether or not a student visa requires an I-864. You can probably find that info easily by logging onto travel.state.gov.

The I-864 is the only affidavit which has legal footing. Anything else does not.
