Timeline

Hello my VJ family,

My wife's ex has finally signed a quit claim for her son so he can come to the US to live with his mother and I. I will be petitioning for my step-son. I have attached the paper that he signed with all personal info crossed out. Does anyone know if his statement saying "he ageed to allow his son to go abroad together with his mother" will be accepted. We are extremely excited that he is finally allowing him to come live with us but want to make sure his statement is accpetable for her son to move here.

I don't know if this will satisfy the consulate. The letter is supposed to give permission for his son to immigrate. I don't know exactly what the original Viet language letter says, but the translation just says that he's giving his permission for his son to "go abroad with his mother". This sounds like he's giving permission for his son to go on holiday. A "quit claim" is a legal document relinquishing claim. In this case, he is relinquishing his claim to certain parental rights. I think the letter should make it clear that he understands and permits his son to immigrate to the US permanently.

I am in the same situation trying to get him to sign a letter. Any words of wisdom that may help us to convince him it's the right thing to do?

This is exactly why I am questioning the wording of this paper. I don't want to file if we are going to have problems with that paper. Tell me what normal human being wouldn't want their child to come live in the US where he can get a better education, let alone the fact that he has very little to do with her son. He has repeatedly told her son, I will let you go with your mom after this or after that, and when it comes time he doesn't do it. Finally he did sign the paper, but was he just trying to play games again???

I am sorry that I have no advice on how to get him to sign it. It just depends on how much of a you know what he wants to be. Good Luck to you!!!

Does anyone know if she would need her ex to sign a paper like this for her to bring her son here on vacation and then he must return?

I am just wondering, because if it is not needed then this might be sufficient. If it is needed then I question his intentions.

Even with the letter it will be very difficultfor him to come to visit... they look at it from the perspective that he is coming to stay and you must prove otherwise...

He may have just been following the instructions which are in packet 4, which say:

An original certified and signed Quit Claim for all minor children (age under 18) giving their other parent’s

permission for them to accompany you to the U.S.

The letter he signed basically does give permission for his son to travel with his mother, though it doesn't specifically say anything about the United States. His letter also should probably have been addressed to the consulate and not the People's Committee.

Maybe you should have an attorney (M.E.?) look at it and see if they think it's adequate.
