Hello everyone,

I originally started the paperwork for a K3 visa. Submitted both the I-130 & I-129F. The I-130 got approved before the I-129. We decide to go the CR1 route and are currently at the step of mailing my I-864EZ and documentation this coming Monday, October 26, 2009. Now of all things, on Thursday, October 22, 2009, I received a letter from the NVC telling my that within 1 week our case is being sent to the Cairo Cosulate for the K3 processing. HELP!!!

I don't want the K3, we want to stay with the CR1 case we have been working on! What should we do? Call the NVC and cancel the K3 or ignore the K3 paperwork like I've read and do nothing? I am only afraid that when my husband is sent a letter and his packet for a K3 and the CR1, that he may get confused and submit the wrong one...CAN THEY REALLY SEND OUR CASE IN 1 WEEK TO CAIRO??? IS THIS POSSIBLE? IS THERE TIME TO STILL STOP THIS FROM HAPPENING?

HELP! anyone please.

Ignore all paperwork to do with K3. Your husband will get confirmation they have his I129f (K3) is in Egypt, ready to be processed. Tell him not to do anything. Have you got an attorney? If yes, then NVC will notify you about Assigning an Agent, DS=3230 form.

If you definitely want to go with CR-1 then call NVC and tell them to drop K3, any mails your husband gets, tell him to ready carefully and get in contact with you. The letter from the embassy will state the type of visa its referring to, so there shouldn't be confusion.

The NVC will ask for nomination of Agent (that could be you, if no attorney), AOS and IV fees (can be together or separate). DS-230 Part 1 signed, along with original paper work:

Birth certificate, yours and your husband and joint sponsor if you need one

Wedding Certificate

Police Certificate(s) (more than one if your husband has resided in any country, since 16 years old, for 6months or more.

No attorney. I am the Agent. My concern was with the case leaving the NVC and being sent to Cairo if I want to pursue the CR1 visa. Should I allow this to happen? Or call the NVC to stop the K3 and keep our case (paperwork) at the NVC until our paperwork for the CR1 clears and our case closes with them first. If the case leaves the NVC for Cairo for the K3 visa...will this create more problems if we are still not finished with our CR1 process with the NVC???

Just ignore anything for the K3 visa, if you write to cancel it, you run the risk of them cancelling everything by mistake... Just ignore the K3 stuff and the embassy's request for it... I think, I am misunderstanding something here. I originally started with a K3 but as soon as the I-130 was approved, I pursued the CR1 instead because my I-129 had not been approved on same day as our I-130. Now, that I am on the CR1 path, currently getting ready tomorrow morning to send out my I-864EZ & documentation for our CR1, I get hit with this letter from the NVC telling me our case will be send to Cairo in 1week. I don't need my case going to the embassy, when I haven't even finished my case with the NVC for the CR1 case! HELP! What should I do?

Just ignore everything realting to the K-3 and follow the directions and requirements for the CR1... When you are complete at NVC, you will be assigned an interview for the CR1 and you will process for the CR1... Ignore the K3, your fine, people do this ALL the time

So even if, my case goes to Cairo Embassy in 1 week our CR1 case is still active and can continue to be processed? I thought the case needed to remain at NVC for them to approve and close our case there first, then - they will forward it to the Embassy in Cairo. Am I wrong?

I've also realized the our IV Bill has not been generated and I feel that because I mailed our DS-3032 by USPS and with Return Receipt, that this has slowed down our process. I thought I read in other threads that this can slow a process down???
