Hi Everyone...

I submitted an I-864W (Exemption from I-864) to embassy in Cairo with my package 3 paperwork because I am a returning LPR who had previously resided in the US for a long period of time (over 10 years). My paperwork was returned to me and the I-864 was requested. I'm wondering if the consulate can make up its own rules as to what forms they will or will not take. Does anyone know.. it clearly states on the I-864 instructions what the exemptions are.... do you think the CO is just not familiar with the forms...

6-22-09 - Filed petition at embassy in Cairo

8-12-09 - Contacted DOS for info on petition...found out petition is filed incorrectly...

8-12-09 - Tried contacting embassy with new info...no response for 3 days..

8-15-09 - Made appt to resubmit petition on 8-17

8-17-09 - CO at embassy informed us that correction was made and petition sent to Athens for approval.

8-26-09 - Petition approved by Athens USCIS

8-28-09 - Petition mailed to Cairo by Dipl. Pouch via Washington DC.

9-29-09 - Petition arrive at Cairo....

10-12-09 - Package 3 arrived and also sent back same day...

11-10-09 - Package 4 arrived

12-22-09 - Interview date - APPROVED

12-23-09 - DOS says Visa Issued

12-30-09 - Visa in hand

12-31-09 - Enshallah arrive back home :)

Are you the intending immigrant who was an LPR?

Yes, the CO has discretion as to what is accepted.

Did you supply documentation (likely from the Social Security Admin) showing that you have been credited with 40 qualifying quarters of employment??

Yes I am the LPR and i did submit the SS statements for myself and hubby. So there is the possibility that they will send it back again :blink:

I have 39 quarters of my own and I think i can have all of my husband's as well because of 11 year marriage. right. BTW the consulate is Cairo.
