Sending in I-751...General questions

Hello,

We're sending in our I-751 application and I just wanted to clarify a few things. First, if my husband (permanent resident) is living in the US, he does not need to send two passport-style photos, correct? Also, I saw in another post under this forum that someone made the check out to USCIS. Isn't it supposed to be made out to U.S. Department of Homeland Security?

Here is what we are including. Any suggestions would be appreciated!

1. Cover Letter and check

2. Copy of Green Card, front and back

3. Tax returns from 2007 and 2008

4. Letter from health insurance, stating date we began our joint plan

5. Notarized letter from bank stating our joint account began in May 2006 and how much we have deposited in the last year

6. Statements from that same joint bank account from various months

7. Statements from a joint personal loan, various months

8. Internet bills (my name, but shows same address)

9. Cable bills (my name, shows same address)

10. Car loan (joint)

11. Car insurance (joint)

12. Car insurance (other car, joint)

13. Moped insurance (joint and expired, but was active after my husband was granted conditional permanent residency)

14. Rent agreement...We subletted our apartment early and moved into my parents rental house where we do not pay rent. I got a notarized letter from my mother stating we live here and we have no legal contract with them.

15. Phone bills (various months, joint account)

16. Receipts/flight confirmation and car rental confirmation printouts from two trips we took to Uruguay to visit my husband's family.

17. Two affidavits of support, notarized, one from a friend and one from my sister.

I think you have enough good evidence there.

Check should be mailed to U.S. Department of Homeland Security, NOT to USCIS.

you are right, if he is in the US he does not need to submit passport photos.

This question is for anyone. Do you have to send tax returns from 2007 also? We filed from the same address for the 2008 tax year but in 2007 I was working in another state so my address is different. At the time of applying and receiving my conditional green card I was at the current address I reside at.

jer216.... everything you have looks fantastic. If you are not already doing so, I would recommend a nice little cover letter itemizing everything on your list so that it makes it very easy to follow. Especially since you have so much good info. Also, what I did was went through with a highlighter to draw attention to the info I wanted examined (e.g. dates, our names at the same address etc.) Also, remember to send your petition off as certified mail with signature required (and yes, you want that confirmation card back).

beakon20 ... it is recommended that you also send 2007. Regardless of where you live it should show your and your spouse's status as 'married'. You should have filed a change of address when you moved, so they will already know about the move you made. You could simply include an attachment explaining the circumstances if it makes you feel better ... or if you are going to loose sleep over it, don't send them and then IF you get a RFE you can send them later.
