If he has to claim the other 2 for his support as well it would bump the family size up to 5 which is 32,237 at 125%, so at that point you need to have a sponsor. Definately have to ask him about the kids and if he claims them or not because that will make a difference.

Thank You Danu. He does not claim the other 2 kids on his tax returns. He just pays child support. What I want to know is if that will make a difference?

Question number 8 in the affidavit asks who is dependent either wholly or partially on the applicant. In my mind he would have to list all children in 1 way or another. My husband did when he filled out the application 2 yrs ago and his boys do not live with him, just visit and he pays child support.

I don't think I understand the question though - make a difference to what? If he's only making 29K a year, even without supporting you too - that's not a heck of a lot. But that's been said here already

Best to get his mother to be a joint sponsor if she qualifies - probably the cleanest way to get affadavit of support completed. She must however have filed tax returns for last three years.

...And Sak it's Ok to be in love with Man who makes 29K - as long as you think it is the best thing for you.

Someone popped in to a thread here in the Canada forum the other day and (quite nicely) started to give people unsolicited relationship advice, which was not what the thread was about.

They were sent flaming on their way.

The OP wants to know for a fact (not just what we think) whether or not her SO will have to claim, on the I-134, his 2 children who he pays child support for, that's what she is asking over and over and hasn't gotten an answer that I have seen, except perhaps from the first person who answered and i'm not sure if they aren't talking about the I-864 rather than the I-134.

Does anyone actually know the answer to this?

Sak, personally, I would recommend that you repost your question in the K1 forum, no need to go in to details of your relationship or your education - just ask them if your fiance has to claim the two children, who don't live with him, on the I-134.

Thank you INK and Trailmix. I really appreciate your response on this matter and thank you for understanding what I was trying to ask. I will go ahead and post it on the K-1 forum and hopefully get an answer. Thank you again to everyone who took the time out to comment on my dilemma
