My first and only trip to Cuba so far was illegal. In other words, I am an American citizen who did not apply for or recieve a govt. permit to go. I went through MX and my passport was not stamped by Cuban officials. Sooo... I am wondering whether this point will come up during any part of the K-1 process. I have not even filed the I-129 b/c I am worried that I could get into trouble (fine or worse) and that I may be denied based on the fact that I met my Cuban on a trip that was not licensed by the U.S. government...

Does anyone have any personal experience with this matter? I want to make sure I am not putting myself in jeopardy...

Thanks,

Katy

To file, you need to prove that the two of you have met in the last two years. Any way to arrange another get-together off Cuban soil and then start the I-129f process? At some point down the road it will be necessary (in order to be truthful) to explain how you first met. But the U.S. is lightening up a little bit on these things, and hopefully that illegal visit will not penalize you -- if you can prove a bona fide relationship and marriage.

From all I had researched before beginning my K1 process was that the USCIS does not communicate these things to OFAC, where the Cuban embargo law technically lies. We're nearly to the interview, and I submitted lots of incriminating evidence as my proof of relationship, yet was still approved in the first steps of the process. I'll also be attending the interview, and from the feedback I've read on this forum, I won't be questioned as to why I'm there, either. If I experience differently, i'll be sure to post it after I get back (mid-november), but everything I've read here (and even consulted a lawyer) was that it should be ok.

do not worry one tiny bit!! The US interviewer at the Cuban Interest Section will say right to you, " hello, are you a US citizen?, don't worry, we are not the police, we do not care how you got here!" FOR ME I TOLD THEM I HAD A LICENSE, as I do and have had but not always , and they could not have cared less. believe me , I have had to go there to get a new passport when mine was stolen last December, I was much more worried then, and now,,, nothing. I will tell you that if you are traveling thru a gateway country Its soooooo much cheaper and much easier than going thru Miami with a license!! MIAMIsucks, and I spent 1+1/2 hours detained in immigration wi other cubans wi resident cards, I'll take cancun or Nassau or jamaica any day faster cheaper nicer. Most important thing, answer the questions about your relationship well and with good thought, and have evidence of all important aspects(support). Make sure the questions they ask about the cuban 5 and communist youth org are answered as NOOOO!!!!! I don't know and NO I was not and am not a member. I watched multiple denials of all sorts of cubans in my many hours wait. lots of reasons but those were the consistent trippers also. usually the reason was not a believable plan for living in the US and enough support... children were often a factor. sad.sad.

BUT I AM HAPPPPPPPPY< MY HUSBAND ARRIVES WEDNESDAY! we are going to celebrate for the rest of our lives. Buena Suerte , cuidate, Juana

One love...
