REF (I-94) & BIOMETRICS CLASHING!...URGENT RESPONSE NEEDED!

Hello All,

I am a Canadian Citizen filing for an AOS and just recieved an RFE in the mail today(10-02-09) reqesting my showing my 1-94 as proof of entry while on the other hand, i had been previously scheduled for my Biometrics appointment next week wednesay (10-07-09). Here are my questions:

(1) As a Canadian Citizen visiting the United States, you are not given an 1-94 so i have written this letter and intend on sending it back to them. Would it suffice?

As regards the request for initial evidence letter sent to me by the USCIS to show proof of my legal entry into the United States, I would love to state that I am a Canadian Citizen and wasn’t issued an I-94 during my entry into the U.S.

I was inspected by a US customs official at Ottawa International Airport and then flew into Hartsfield-Jackson Atlanta International Airport, Georgia.

I have attached to this letter, a copy of the Bio data page of my Canadian Passport showing my country of citizenship (Canada), a copy of the boarding pass used for the said travel, as well as a copy of my flight ticket and nexus card (which was inspected by an immigrations officer)

(2) Should I still go in for my Biometrics appointment?

(3) How long might it take for my case to resume assuming USCIS gets my response within 2 business days of sending it?

(4) I previously worked in the U.S on a TN-1 Visa before marrying my USC wife and then moving back to Canada after my employment. During the period of my employment, i applied for and received my SSN. Now that i have applied for an EAD based on my AOS application, would i be issued another SSN or since i wrote my SSN on the AOS application, i can continue using the old one as long as my EAD is approved.

09-28-2011- Biometrics Appointment Notice received for 10-12-2011

10-03-2011- Went in for early Biometrics

08-03-2012- Removal of Conditions Approved

Application for Naturalization(N-400)

12/23/2012 - Sent the package to Dallas drop box

11/27/2012 - Package was received

11/30/2012 - Check cashed

12/06/2012 - Notice Of Action received (Dated 11/29/2012)

12/07/2012- Biometrics Appointment Notice received. Biometrics scheduled for 12/18/2012

12/10/2012- Early Biometrics done

Timeline

1) I think you should be fine with what you are sending.

2) You go to your biometics appointment regardless. I even did a walk-in (10 days before the actual appointment) while my case was on hold,and my cases were updated that day.

3)They recieved my RFE 5 days before I went to bio appt, and apparently the walk-in sped up the update :) I wonder if I didn't do a walk-in,how long would it take for them to update my case??? I read sometimes they never update it ("case placed on hold" status, and people recieve interview letters regardless)...

4) Idk what the SSC looks like with T-N1 visa, but your SS number stays with you forever, it's like your identity. So, you may have to get a new card, but you would put your previous number on the application.

When you get your EAD and go to the SS Center, you should ask them this question just in case, they should be able to help you. You may also want to call USCIS customer service to see what they say.

2-year green card application:

07/29/2009- Mailed I-130, I-485, I-693, I-864, I-864A, G-325A, I-765 via USPS.

08/02/2009- Package delivered to Chicago.

08/06/2009- Checks cashed.

08/10/2009- Received NOA's for I-485, I-130, I-765 (issued August 6th).

08/19/2009- Recieved Biometrics Appointment notice (bio apt 9/12 at 9am).

08/21/2009- Recieved RFE for I-485 (issued August 17th).

08/22/2009- Responded to RFE.

09/01/2009- Case processing resumed (RFE recieved on 8/27/2009).

09/01/2009- Walk-in biometrics at 1:00pm, in and out in 15mins.

09/09/2009- Recieved e-mail: EAD card production ordered on 09/08/2009.

09/14/2009- Recieved another e-mail: EAD card production ordered (AGAIN!) on 09/11/2009.

09/16/2009- EAD recieved in the mail.

09/21/2009- Applied for a SSN.

09/30/2009- Recieved SSC.

10/14/2009- Received interview notice (Interview on 11/16 at 9:35am)

11/16/2009- Interview,APPROVED and CARD production ordered e-mail!Yay!

11/19/2009- Welcome Notice Recieved and Card production ordered e-mail again!

11/27/2009- Received green card in the mail!

Removal of Conditions:

09/09/2011- Sent the package via Priority mail, with delivery confirmation.

09/12/2011- Package delivered.

09/13/2011- Check cashed.

09/14/2011- NOA issued and received on 09/17/2011.

09/15/2011- Biometrics appointment issued for 10/05

11/21/2011- Card production ordered.

As far as the I-94 is concerned, I was told that once you file out your paperwork, you should just add "N/A Candian Citizen" where they request the I-94#. I know, it doesn't aply to you anymore, but I'm putting it here just in case someone needs the same kind of info. :star:

As for your letter, I think it'll do. I personally don't even have proof of entry and was told by other VJers, and someone from a Community Help Center that it shouldn't matter. They know that Canadians are not required to show a lot of things when they cross over.

12/31/10 ------- Received Interview letter

02/07 ------- Visited him in the U.S. for what was suppose to be a few weeks (Came in with birth certificate and health card. Health card expired a few months after)

08/07 ------- Decided to get married because we didn't want to be apart (in the U.S.)

10/10 ------- USCIS Medical Done
