Hi Everyone, my name is Ann from the Phils. I am new in this forum and would like to seek help on filing K1-Visa.

Thank you for the guides you have placed here,it's very helpful. Need answers to some questions, and i hope you can help me

1. My fiance is working in a Iraq and i need to sign some forms. It's easier for him to send me than for me to download the forms

sign and send to him cause some packages going to him can take very long to arrive or worst get lost. My question is, Is it alright to send the application (complete packet) from the Philippines to the USCIS?

2. We're a bit confused whether to use N/A or none as an answer, can you pls. tell us whats the difference? or to which item show we use none/n/a

3. My fiance has a copy of the divorce decree only of his 2nd ex wife, does he have to mention in the application about the 1st wife? the thing is that he doesn't have the divorce decree with him anymore coz he is in iraq and the divorce decree was left in what one of his homes which has been sold and things on warehouse he doesnt have access to while away, and we want to already file the k1.

4. He is a private contractor in Iraq servicing the marines but not a military man, he is based there, and so correspondence will have to through his residence adress in u.s.a, it this okey as long as there is a relative in his house who can receive it.

5. how many photos do we need to submit as proof of meeting? (my fiance has visited me 4 x since we met, in april 2009, his last trip was this month and got engaged)

additional advise/reminder in filing that would help other than the questions i asked is very much welcome. thank you.

Shouldn't be a problem. You can file the I-129F from abroad, but it has to be sent to one of the two USCIS service centers in the US that process K1 visa petitions. Which one depends on the last place the petitioner lived in the US. He will have to return so you can marry in the US once you arrive with your K1 visa.

Check the example forms for when to use which:

It can get confusing, because sometimes either answer seems like it would be appropriate. For instance, the example form says "None" for "Names of prior spouses". If it were me, and I'd never been married, I would have thought "N/A" would be more appropriate, since the question wasn't really applicable to me. Use your best judgment. When in doubt, use "none".

Yes, he will need the divorce decree for his first wife. He can usually get this by contacting the county clerk in the county where the divorce took place. The cost is usually small, and doesn't usually take more than a couple of weeks to get. Most counties have a web site which describes how to request a copy of a divorce decree.

Yes, should not be a problem.

Photos are secondary evidence. Primary evidence is stuff like boarding passes, passport stamps, receipts for money spent in the beneficiary's country (if that's where the meeting took place), etc. As long as you've got sufficient primary evidence, you don't need more than a few photos. However, anything you include in the petition will be forwarded to the consulate. If you think it will help you at the consulate to have some front loaded evidence of a relationship, then feel free to add more photos or other evidence.
