BTW It wasn't you I was referring to above but didn't you guys do this also ? Eeek. See what I mean? It's so long ago now I almost forget

Yes, it's been a loooonnnng time. We were able to file for my DH after I was told I couldn't do it there because we were not getting married in Romania. Fortunately, my persistence won out when I got them to explain to me what requirements would be acceptable for us to file. And, interestingly enough, I saw that they had a file for us prepared in my maiden name, with all the correspondence I sent to them BEFORE the initial interview. Good thing I kept my cool when they iniatially told me I couldn't file there.

I think that is VERY VERY important.. I was talking with someone here at work who when she was immigrating here from Canada.. some lady was raising all hell at the embassy because of something and she was denied.. Key point here is the US is looking for people that are going to benefit the country and stay married.. instabilities show.. (just my oppinion and experiences)

Hi Maimu

If you have a very solid case (few or no red flags, evidence of a long ongoing relationship, man is USC)

you might have a really good experience with DCF in Bucharest.

We tried it but were not successful, due to complications in our case. I can tell you however, that an email to the embassy with your wedding date and an extremely polite request ought to get you an invite for filing I-130 directly. Try <visasbucharest@state..gov>. If it doesn't work you'll have to file an I-130 from scratch with your service center. The K-1 shoulnd't be an impediment unless of course you DO have red flags, etc..

Here's what they told me:

> American citizens may file immigrant visa (I-130) petitions on behalf

of

> their spouses at the U.S. Embassy in Bucharest under certain

conditions,

> as an exception to the normal process of filing the petition with the

U.S.

> Citizenship and Immigration Service (USCIS) in the United States. We

will

> accept a petition filing in Bucharest if the beneficiary has no

> immigration problems in his past, if we have no concerns about the

bona

> fide nature of the marriage, if all the documents are in order, and

if the

> petitioner is present in Romania long enough to file the petition.

Noroc!

Jaci

Thank you so much for your advice. It is my believe as well. I already have a valid 10 years B2 visa, I was there many many times .. we have a stong case I think (family pictures, pastor papers, airline tickets etc etc). I have no doubts that they will accept our case. The only thing that puts me back is this K1 petition but now ... leggaly talking i am not doing anything wrong. I know its a fraud for me to get in US with K1 visa when I am ALREADY married but I am not planning in doing this.

I'll pray and I am sure God will help me do the best thing.

God Bless!

Oh I knew that you could file overseas if you resided there and married, that wasnt the issue. I just didnt realize that it cut months off the waiting time as figured it went thru the same process that it would if I filed here. That was what surprised me, that by doing that it seemed to go around the normal processing time.

If one prepares ahead with all the documents required to obtain the IV, then time can be cut dramatically by doing DCF. At most embassy's, the I-130 can be adjudicated the same day. That cuts 3 - 6 months off of the wait time in the US alone. Unfortunately in the US, there are too many steps involved...pay this first, send document, pay this next...etc.
