Background: US Citizen filing for child (under 21) I - 130

On 5th September I received an RFE asking for a Birth Certificate, I sent it on the 10th of September, and today I received an email where they have stated receiving the required documents (14th September).

Now: How long until it gets approved at the USCIS, as my child will be turning 21 in December ( I know CPA applies, but not when it is sent to the NVC) how long should I expect until it gets approved and how much time does it take to be sent to the NVC after that period? On average?

Once it has been approved and sent to the NVC and assigned a case number, I will be sending them an email about expedited processing but I am just wondering how long it until it gets approved and sent.

Anyone have any ideas?

EDIT: Service center is California, and most likely NVC/Consulate is the one in Montreal, Canada.

Note: Beneficiary is filing from Canada.

Thanks,

Only 5 days? That's quick alright!

I'm guessing another 5 to 10 days for it go to the NVC then right?

Anyone have relevant experience with the expedited processing at the NVC?

Having the case expidited at NVC is not going to speed things up that much but it will help, The time it takes is dependant on how quickly you can get all the paperwork to NVC. Your problem is going to be getting a interview date. I have seen many people from canada have to wait over 2 months to get a interview date. So you may want to look into getting a expidite for the Embassy stage of your childs application.

You can ask in the Canada forum about timeframes for getting interview dates for people doing IR1/CR1 visas as they are the same catagory of Visa (Immigrant visa for immidiate relative of a US Citizen).

Thanks,

December is coming FAST. Be prepared to get thru NVC as fast as possible. Check on using "Ling Che's NVC shortcuts". Main thing is to have all the required documents ready to submit as soon as asked for.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I would just like to add that there is a very long waiting list in Montreal right now. There are several people whose cases were complete in June that are still waiting to be assigned an interview. Unfortunately there seems to be a 3-4 month wait at the moment. Good luck! There are people in the Canada forum who can give you more specific information about Montreal.

When I had initially filed the application along with my spouse for my child, my child's application was 'rejected' in the sense that it was to be filled separately, at which point I had already sent both the papers for my wife and child to the NVC (my wife had her interview last month and got the GC). Now, I am not sure what they did with the application of my child, kept them or discarded them? If they did keep them.. does that matter at all or will they require me to refill everything along with the fees?

I thought they give priority for the people who are soon to turn 21 over at the NVC? Is that not true at all? I haven't gotten the approval or gotten a case number from the NVC so I can't really do anything right now other than prepare for that moment when that email does come in with the case number so I can take immediate action in contacting the NVC and telling them of my situation.

I have photocopies of all the documents that I've sent previously, so I think i'm good in that department, now I guess its just the wait to get a case number from the NVC?

that's definitely not good, I hope they prioritize because in the event things go past my child's birthday I think its a separate category so I have to file once again? G-D DMA IT!

Can you please link me to the Canada forum? I'm sort of an amateur at this stuff hehe :)

I'd give your senator a call. They may be able to help. Mine sure has. Not to expedite tho. His staff just got our petition moving again.

My senator? As in my state senator? Are you sure they can do anything about it? You said they can't get it to expedite, which is my main problem.. my file isn't stuck i think.. infact it should be approved within a week.. but this NVC stuff is scaring me now.
