Even though my fiance and I are waiting on our NOA2 for the K1 visa, we have decided to go ahead and compile the forms for the Embassy interview (in London) and for the Adjustment of Status package that we'll send off after we get married (Next June all going well).

On the "Guides" section of this website it says that for AOS we should send off I-864 Affadavit of Support, but, I have also come across form I-134 also. Which one should I use for AOS and which one should be completed ready for the Embassy Interview?

Also another thing... does anyone know when filing for AOS, should the beneficiary's name on the paperwork be her new name? As, I will then be married and taking my fiance's name, or should it all be in my maiden name, as per the I-129F Petition?

I-134 for the interview, I-864 for AOS.

I haven't made it this far yet (so more experienced hands are encouraged to correct me if I'm wrong or concur if I'm right!) but if you're planning on taking your fiance's surname after marriage, I'd guess that you'd use that name on your AOS application—that's how you'll want it to appear on the green card, after all. There's a question on page 2 about your name as it appears on the I-94; your maiden name will go there.

Improved USCIS Form G-325A (Biographic Information)

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.

As stated before, I-134 for the interview, I-864 for AOS.

After we were married, my wife applied for the Social Security card with her married name. Once she received that (about 7 days), we filed for AOS with her married name. Now all documents from Immigration have her merried name.

Thank you both of you. I have looked everywhere for that information but couldnt find it anywhere. It should say on VJ somewhere the difference between the two Affadavits of Support, because I'm sure I'm not the only one getting in a pickle over the two forms.

Oh and also, did either of you make a brief explanation of the name change on AOS, or is that unnecessary?

I'm trying to put this in the gentlest way possible... the guides reward a careful reader.

VisaJourney K-1 Guide:

4.I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.

It should be reasonably clear, considering that the new surname will be the same as your husband's surname—which you'll be listing on page 2 of the I-485.

Thanks, but there are many, many editions available out there, of forms that are needed to be completed throughout the whole K1 process and I did see the two guides, but I have already seen some confusion on VJ about the two Affadavits of Support and wanted to get a clear answer. I didn't think people minded answering queries on the forums... Thats why I asked. I certainly don't mind assisting people who are unsure...

This page lists all the forms you will need at each stage of the k1 process as you can see the I134 is listed at the visa stage there is no I864, you will also notice at the AOS stage there is the I-864 listed again there is no I134. I can assure you if you do the items in the process according to the guides and the example forms page you will have very few questions throughout the process aside from procedural items.

Getting upset because someone points out the obvious after you say you have read the guides will only make the process that much more strenuous.

OH yeah...if you are gonna change you ss card to new name do it before you have elapsed 76 of the 90 days your I-94 has. BUT even if you don't get the ss card changed to the married name fill out the AOS paperwork in the married name so all AOS documents will have it. The certified record of marriage will be all you need to prove it.
