Hi!

I am just putting together the final touches of my AOS application (from J1 visa) and i'm checking everything i have against the i-485 and i-130 instructions, and then against the instructions listed on VJ at http://www.visajourney.com/forums/index.ph...page=i130guide2.

I have found a couple of discrepancies - for the i-130 package VJ says to include:

A copy of the intending immigrant's birth certificate and/or passport along with English translation.

However i can't find the part where they ask for this in the i-130 instructions????

For the i-485 package VJ says to include:

Copy of the non US Citizen Spouses Passport (biographical page as well as entry stamps).

Copy of the non US Citizen Spouses valid I-94 (front and back copies)

A certified copy of your marriage certificate. (If filing for your spouse)

I can't find where the i-485 instructions ask for these either. The last one's confusing me because i thought i was filing the i-485 for myself but as i'm filing concurrently with an i-130 should i include the marriage cert? I'm already including one with the i-130.

I really don't want to include anything unnecessary because i don't want any chance of irritating the people on the other end! :innocent:

But maybe i'm just missing something in the instructions for the i-130 and i-485 (very possible at this stage, i'm so sick of re-reading them!)

Think of the 2 different forms as separate applications. Always duplicate the evidence for each application as they are not neccesarily adjudicated in the same place.

The USCIS instructions are not always clear, but there are 100's of people who have used the VJ guides to submit successful applications. The guides seem to air on the side of caution and account for all evidence that is required.

You wont irritate by including the unnecessary but you could incur severe delays by failing to include the essential.

Always air on the side of caution.

08/31/2009 - Cheque cashed

09/05/2009 - Biometrics notice received

09/23/2009 - Biometrics Appointment

09/23/2009 - I-485 Transferred to CSC

10/02/2009 - EAD Approved (card production) & AP approved!

10/11/2009 - EAD Card received

10/20/2009 - AOS approved, GC card production ordered! (53 days in total)

10/26/2009 - Green Card received - nearly 11 months to the day of our K1 NOA 1!

11/25/2009 - Started my new job!

02/26/2010 - Passed my driving test :-p

07/20/2011 - Eligible to remove conditions

2012 - Going for citizenship

09/20/2011 - Removal of conditions submitted to VSC....here we go...again!

It's been a quick and relatively painless journey thanks to tireless research, dumb luck and this community :)

DONE with USCIS for a while :)

No harm in attaching additional documents. Less could unnecessarily delay your case. I followed VJ's guidelines and advices given to me at various points from day one and have been successful till now.

May.29.2009 Got married!!!

July.22.2009 Sent our AOS paperwork I-130(g-325) and I-485(I-131, I-765, I-864, g-325)

July.28.2009 Immigration Received Paperwork

July.31.2009 Received NOA (I-130, I-765, I-485, I-131) and ASC Appointment Notice

August.27.2009 ASC Appointment (biometrics)

September.01.2009 Card production ordered

September.02.2009 Received Approval notice I-765

September.04.2009 Received Advance parole in the mail (I-131) =) yaaay i get to go home in December!

September. 11.2009 Received employment card :)

September.14.2009 Received Request to appear for initial interview

October.21.2009 INTERVIEW

Got approved that same day and i received my Residency Card 2 weeks later
