K1 Visa No AOS filed but emergency travel required

No AOS (I-485) filed, no basis for AP... no basis for AP I would expect no emergency AP

You would need somehow to get the Consulate to re validate the K1, or start again.

Presumably a co sponsor must have been involved?

No AOS no EAD no job.

No I make decent money. I actually had to qualify for 7 people...and did so without a co-sponsor and with room to spare.

I have had two neck surgeries within the span of a year...and have been fighting with my job about disability pay since 2007. I can pay my mortgage...other utilities and keep my kids fed...but I just don't have the funds immediately available for AOS...not that I can't ever pay the fee. Unfortunately, his situation can't wait until I get out of my temporary crunch.

I wasn't worried about EAD or him getting a job right now...all I needed to know was could he get emergency AP status since his daughter is sick.

Jan 20, 2010 ~~ USCIS acknowledged receipt of RFE on I-485 only

Jan 22, 2010 ~~ I-131 AP and I-765 EAD approved (email notice on 1/25/10)

Jan 28, 2010 ~~ USCIS email that I-485 was transferred to CSC on 1/26/10

Jan 30, 2010 ~~ Received EAD and AP via US Postal Service

Feb 01, 2010 ~~ Received notification of case transfer via USPS

May 07, 2010 ~~ Email notification that card production ordered for 1-485

Jun 01, 2010 ~~ Greencard finally arrives w/approval date 2/23/10 (Huh??)

Done until November 25, 2011!!!

You cannot apply for AP without having filed for AOS :(

Wish I could offer something more....

I figured as much...right now I'm trying to decide if we will get married and I will just start the process over as CR1. I love him and his girls...but I can't stop feeling like this is a ploy...and that makes me angry that he still hasn't learned that she is crying wolf.

God is so good. He just came in the room and told me that he can't or won't jeopardize how far we have come because she wants to use their daughter's illness as a way to get him back to Jamaica. He is talking to his mother and family, and his daughter is okay...she still needs surgery...but she is not any worse than she was when he left.

hey jawi.. i am glad that the truth came out.. its very sad to have to deal w/ this stuff.. i too think (hate to say) that rg's heart strings are being pulled.. its always something w/ the children..supposed diabetes that we never got the FULL story on, still going for followups every week :blink: , upset calls about constant crying which for a teething baby is quite normal :whistle: , all of this really worries him rightfully so.. i of course am as concerned, but in the back of my mind i can't help but think these are scare tactics.. :whistle:

well again.. thank God for it all being brought to light and God Bless on TOMORROW.. may it be one of the happiest days of ur life mami!!!!!!!!!!
