Your relative is in the United States and will apply for adjustment of status to that of a lawful permanent resident at the USCIS office in:

it also states: If your relative is not eligible for adjustment of status, he or she will apply for a visa abroad at the American consular in:

_______________________________________

(city) (Country)

My question is what does it mean by "not eligible"? If you are in the country legally, are you eligible? Does anyone know to look for the guidelines in writing? In the US CODE. Not ametuarish answers please.

I've also heard that you can file the I130, I485 and a I765 all at the same time.

since they are eligible for adjustment then ignore it....

The I-130 is used for both AOS candidates and visa candidates... a visa candidate is NOT eligible for adjustment of status because they have no status yet in the USA

Yes they can file the I-130 and AOS all at the same time. Where the form refers to "not eligible" that would apply if a visa number was not immediately available for the US legally. They would have to wait for a visa number to become available, so they would have to leave the US and wait for a visa in their own country and that is where the interview would take place.

Your answers does not make sense. How are my parents qualified? Anyone know how to file the aos and EAD along with the I130?

Have a read of the guide for people who are doing AOS and I-130.

where it says spouse read Parent. The process is the same.

eligible means presently in the US with a legal status (ex. parent is on a working visa and therefore can apply for AOS), ineligible means not presently in the US and therefore needs to apply for a visa to get into the US (after your I-130 is approved)
