The Scottish Justice minister is supposed to make sure that the law is applied fairly and equitably; I'd like to know how many Scottish mass murderers have been released so soon for a merciful reasons ( terminal illness) per Scottish law.

I think you have to be looking at the question backwards to view it that way. What is compassionate release? It's not a judgment on guilt or inocence or in fact a judgement on the crime or the nature of the criminal.

What it is is making a determination that a degree of mercy should be shown to any prisoner who is about to die from terminal illness, where that imminant death can be reasonably be foreseen. The real question the justice minister faced, was whether it could be reasonably determined that he was as far as is possible to tell medically within the last 3 months of life, or whether in fact there was any treatment available that would significantly prolong life.

Under no circumstances under Scottish law is any prisoner left to die in a prison cell without access to paliative care so the question becomes, should that paliative care take place within or without the prison system. Scottish law has deemed that in the circumstances when death is imminant, it is right for prisoners to be released rather than die in a prison hospital. If one looks at that with any degree of openmindedness rather being clouded by the heinous nature of the crime committed (which is obviously not an easy task, particulary if you are personaly involved to a greater or lesser extent) it is surely not beyond the wit of man to determine that such an act of mercy is not some sop to terrorism or terrorist regimes - no matter what way the winds of political expediency are blowing.
