Well i have couple questions regarding the I-864, ill give a brief description of our situation. I am the petitioner, and am filing for my wife (k1) and step daughter (k2), i originally read that since the K2 is under 14 and has immigrated within 6 months that we dont need 2 separate I-864, but then i have read here that i do need 2 separates, which is correct? also, part 3 question 9a i listed the K2 because she has immigrated within the 6 months. what i dont understand is Question 24d and 24e. in the example form they check 24e and write the name of the immigrant. and if im not mistaken I-864a is only when an immigrant is contributing their income with mine......but 24e contradicts my situation (k2)

Question 24e - The person listed above, , does not need to complete Form I-864A because he/she is the intending immigrant and has no accompanying dependents

i know my question is kinda confusing because its hard to explain......sorry and thanks.....

I am a US citizen and my wife arrived on K-3 with no children, so not sure if I can be lf much help, but here is my thoughts:

Assuming: (Derivative) K2 visa was received at the same time K-1 was issued.

A separate I-485 is needed for both intended immigrants.

I-864 and I-864A information is confusing in this area, so I don’t have an definite answer, but, I would likely try filling out the I-864A along with I-864.

Reason is, on page 7 of the instructions it states; “He or she does not need to complete Form I-864A, Contract Between Sponsor and Household Member, unless he or she has an accompanying spouse or children.” So, even if the income is (zero) for the “Household Member”, it is still required.

That is my understanding of the wording.

I hope this helps and hopefully, someone else knows for sure.
