Hi all my girl had her name changed (because it was to long) about 12 years ago when she was about 15yrs. old. I know she will need the docs for this and she says they are at her moms house about 10hr drive from where she lives. The embassy website says to bring name change docs to the Interview but on some things that I read it says that it should be sent in with the I 129F. Can we wait and take it in to the embassy or do I have to mail it with the I 129F? It would be better if we can wait she has a ID card and passport in the new name only her birth cert wil be in the old name. any advice?

is her name is legally changed...then you need to send together in your i129f just send the photocopy of it and when she has interview she needs to present the original copy of the name change.hope this helps.

You will need to submit evidence (and English translation) of the name change with your I-129f package. Rules of originals/copies still applies, so copies will be fine with the petition (with originals possibly being required for the interview stage).

I-129F instructions (Page 3, Section 6C)

'If either you or the person you are filing for is using a name other than that shown on the relevant documents, you must give USCIS copies of the legal documents that made the change, such as a marriage certificate, adoption decree or court order."

Name change documents are not requested with the I-129f. It only asks you to list other names used. She will need the name change documents for the interview and they need to be translated if not in English. The ONLY documents you need from her for the I-129f petition is her signed letter of intent to marry, her signed G-325a and a copy of any divorce or annullment certificates from previous marriages. That is all.

Karin und otto. You are such a great contributor and always right on top of things...Thank you so much, really. You make this site great. BUT (oh NO! It's the Butt Monkey!) in error this time.

The quote is wonderful but note it says that if the person applies in a name "other than that shown in the relevent documents". This will not apply to the foreign beneficiary as she does not submit any "relevent" documents in a name other than submitted with the I-129f. The only documents she submits are an intent letter, G-325a and divorce certificate (if any). Since she changed her name at a young age I surmise those documents are in her new name.

If this were the case, most all foreign women beneficiaries previously married would have to submit their former marriage certificate with the I-129F, and this just ain't so. (but at the interview...yes)

Thank you so much everyone. So I will just put her old name on the I 129F and we will have the name change paper translated and ready for the interview at the embassy.
